If the Council is interested in pursuing similar or different smoking restrictions for multifamily rental housing, staff would recommend that Pleasanton staff speak in detail with staff in each of these communities to find out how their restrictions have been enforced, their recommendations, and other practical advice. City staff would also use other resources for researching proposed regulations that have been provided by interested members of the public. Areas for research and comparison include: (a) minimum number of multifamily units in a development to be subject to smoking restrictions; (b) whether restrictions apply only to rental multifamily units (c) whether to allow designated smoking units; (d) whether to restrict smoking in common areas; (e) treatment of unenclosed patios, decks, and other private areas; (f) any signage requirements; (g) any rental agreement disclosure requirements; (h) timing for restrictions to go into effect; and (i) enforcement options. When proposed regulations may impact residents and the business community, staff typically conducts outreach before presenting any suggested ordinance to the Council. Staff recommends that any proposed smoking restrictions be discussed with the ' Housing Commission, the Chamber of Commerce, as well as any residential rental organization / property managers group. If the Council amends its Council Work Plan Priorities to add a study regarding Multifamily Rental Housing Smoking Restrictions, the expected timeline would be: Jan. - March 2016: Research ordinances in other cities, speak with enforcement staff in other cities, review other sources and draft ordinance proposals April — June 2016: Present proposals to the Human Services Commission, Chamber of Commerce and rental property organizations. Refine proposals based on such meetings July - August 2016: Provide Council options and recommendations regarding potential ordinance Page 6 of 8
