If the Council is interested in pursuing similar or different smoking restrictions for <br /> multifamily rental housing, staff would recommend that Pleasanton staff speak in detail <br /> with staff in each of these communities to find out how their restrictions have been <br /> enforced, their recommendations, and other practical advice. City staff would also use <br /> other resources for researching proposed regulations that have been provided by <br /> interested members of the public. Areas for research and comparison include: <br /> (a) minimum number of multifamily units in a development to be subject to <br /> smoking restrictions; <br /> (b) whether restrictions apply only to rental multifamily units <br /> (c) whether to allow designated smoking units; <br /> (d) whether to restrict smoking in common areas; <br /> (e) treatment of unenclosed patios, decks, and other private areas; <br /> (f) any signage requirements; <br /> (g) any rental agreement disclosure requirements; <br /> (h) timing for restrictions to go into effect; and <br /> (i) enforcement options. <br /> When proposed regulations may impact residents and the business community, staff <br /> typically conducts outreach before presenting any suggested ordinance to the Council. <br /> Staff recommends that any proposed smoking restrictions be discussed with the ' <br /> Housing Commission, the Chamber of Commerce, as well as any residential rental <br /> organization / property managers group. <br /> If the Council amends its Council Work Plan Priorities to add a study regarding <br /> Multifamily Rental Housing Smoking Restrictions, the expected timeline would be: <br /> Jan. - March 2016: Research ordinances in other cities, speak with enforcement <br /> staff in other cities, review other sources and draft ordinance <br /> proposals <br /> April — June 2016: Present proposals to the Human Services Commission, <br /> Chamber of Commerce and rental property organizations. <br /> Refine proposals based on such meetings <br /> July - August 2016: Provide Council options and recommendations regarding <br /> potential ordinance <br /> Page 6 of 8 <br />
