CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 775 <br /> <br /> AN ORDINANCE AMENDING IN ITS ENTIRETY ARTICLE 2 <br /> (WATER CONNECTION FEES) , CHAPTER 9 (WATER) , TITLE II <br /> (ZONING AND DEVELOPMENT) OF THE MUNICIPAL CODE OF <br /> THE CITY OF PLEASANTON. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br />Section 1. Article 2 (Water Connection Fees), Chapter 9 (Water), <br />Title II (Zoning and Development) is hereby amended in its en- <br />tirety to read as follows: <br /> <br /> Article 2 <br /> <br /> Water Connectio~ Fees <br /> <br /> ~2-16.21 Connection char,ge.s. To establish appropriate <br /> provisions for the construction and expansion of the <br /> water system of the City, including transmission mains, <br /> storage and pumping facilities, and to be assured that <br /> the cost of such constructin and expansion is borne <br /> by those who receive the benefits thereof, there is <br /> hereby established connection charges for all connec- <br /> tions made to the water system of the City after the <br /> effective date of Ordinance No. 466, September 9, 1966. <br /> <br /> The amount of the connection charge shall be in accord- <br /> ance with the amount specified in the Resolution <br /> Establishing Various Fees and Charges for Municipal <br /> Services of the City of Pleasanton. <br /> <br /> Water connection charges shall be paid for all new <br /> construction connected to the water system regardless <br /> of the fact that the construction may be replacing an <br /> existing use that was demolished or discontinued on <br /> that property. The charge shall be the difference <br /> between the current connection fee of the time of con- <br /> struction and any connection fee previously paid by <br /> that property. However, water connection charges shall <br /> not be levied for temporary uses. For the purpose of <br /> this article temporary uses shall mean those uses which <br /> are reasonably expected to be completed and removed <br /> within six months of the connection. The Director of <br /> Public Works shall determine whether a use is a temporar <br /> one, subject to final determination by the City Council <br /> in the event of an appeal. The Director of Public Works <br /> may extend the period in which no connection fee is <br /> paid for a period to not exceed an additional six months <br /> upon finding that the use shall be concluded within <br /> that time period. <br /> <br /> All revenues derived from the connection charges herein <br /> provided for shall be deposited in the Water Improvement <br /> Fund. <br /> <br /> <br />
