RESOLUTION NO. 15-805 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> AUTHORIZING THE MAYOR TO EXECUTE AMENDMENT ONE TO AGREEMENT TO <br /> PROVIDE RECYCLED WATER TREATMENT AND DELIVERY SERVICES BY AND <br /> BETWEEN DERWA AND THE CITY OF PLEASANTON <br /> WHEREAS, the City of Pleasanton and DERWA entered into an Agreement to Provide <br /> Recycled Water Treatment and Delivery Services dated January 7, 2014; and <br /> WHEREAS, the City of Pleasanton has completed planning and design of, and is now <br /> constructing the Pleasanton Recycled Water Infrastructure Expansion Project; and <br /> WHEREAS, the City of Pleasanton and DERWA anticipated locating Pleasanton's <br /> "Primary Point of Delivery" (the Pleasanton Turnout) near the DERWA treatment facilities; and <br /> WHEREAS, the City of Pleasanton and DERWA agree locating the Pleasanton Turn Out <br /> one thousand five hundred (1,500) feet downstream of the treatment plant on DERWA "Pipeline <br /> AB" reduces the disruption and impact to the DERWA treatment facilities but increases DERWA <br /> operating cost for power; and <br /> WHEREAS, locating the Pleasanton Turn Out further along Pipeline AB reduces City <br /> capital cost; and <br /> WHEREAS, maintaining the existing "Val Vista Point of Delivery" eliminates future utility <br /> access issues into the Dublin San Ramon Services District Regional Treatment Facilities and <br /> reduces City capital cost; and <br /> WHEREAS, the parties wish to enter into this Amendment One to implement the <br /> facilities configuration identified during Planning and design of the Pleasanton Recycled Water <br /> Infrastructure Expansion Project to the mutual benefit of both parties; and <br /> WHEREAS, The DERWA Board of Directors has already unanimously approved this <br /> Amendment at its October 26, 2015 Board meeting. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> S ECTION 1. It authorizes the Mayor to execute Amendment One to Agreement to <br /> Provide Recycled Water Treatment and Delivery Services by and between DERWA and the City <br /> of Pleasanton. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on 17h day of November, 2015. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 17th day of <br /> November, 2015, by the following vote: <br />
