The gate to the park to the public right-of-way to <br /> Iron Horse Trail will be open. The school itself has recreational amenities on site, a playground on site <br /> and open space the school plans to use. There was not a desire to accommodate play structures on <br /> this site so the applicant team designed the park mainly to accommodate recreational needs of <br /> residents in the vicinity and intended to be a passive park where people could picnic in and play ball or <br /> catch. <br /> Vice-Mayor Brown asked and confirmed that the gate could accommodate students of the Montessori <br /> West School who could walk students down as well as residents, to use the park. <br /> Vice-Mayor Brown said her understanding is the density of the homes is very narrow under the PUD. <br /> She asked if the area from the house to the side yard is 3 feet and voiced opposition for this amount of <br /> space given the need for garbage cans and walking space. Mr. Weinstein said they will operate <br /> functionally well. The side setbacks range down to 5 feet and the rear setbacks range down to 8 1/2 feet <br /> which might have been adjusted slightly with revisions. It is a relatively tight site design and something <br /> that work find in terms of residents using their yards. Others might desire a larger back, side or front <br /> yard, but this is not dramatically different from other projects seen in the City. <br /> Vice-Mayor Brown said if the church relocates and goes to another area in Pleasanton, she said their <br /> relocation must be taken into consideration and Mr. Weinstein confirmed this is taken into account. <br /> Councilmember Narum referred to conditions of approval number 15 which states "This conditional use <br /> permit shall lapse and become void one year if there is no building permit." She asked if this refers to <br /> having to build the third building for the school. Mr. Weinstein said the City wants projects to start in a <br /> timely manner. The fear is that applicants might hold onto their approvals and conditions have changed, <br /> so this condition is meant to move the project forward including operational changes the school is <br /> requesting. <br /> Councilmember Narum said the City has conditioned the school to conduct traffic and parking studies, <br /> given the concern of the school enrollment up to 294 students. She voiced concerns with requiring the <br /> school to be built within one year to keep their CUP. <br /> Community Development Director Beaudin explained that this relates to executing the 120 student <br /> school opportunity and any improvements that would have to be built as part of that project, such as <br /> parking lot, tenant improvements or site modifications and not related to the larger school application. <br /> Councilmember Narum suggested the condition be clarified a bit. <br /> Councilmember Narum asked and confirmed with Mr. Beaudin that the City is allowed to approve 4 <br /> General Plan Amendments per element per year and that there have been one or two GPAs thus far <br /> this year and staff monitors this. <br /> Councilmember Pentin asked and confirmed the limit is 4 GPAs in a calendar year. <br /> Councilmember Olson said he would like to be sure the project is conditioned such that the HOA which <br /> is formed here is going to have to be responsible for some of the maintenance activity on Ironwood <br /> Drive. Mr. Weinstein said HOA discussion is a private party discussion and he knows the developer is <br /> interested and has begun this dialogue. The City is not making it a requirement for this project given <br /> how the project is presented and what is being requested of the City and this process. Mr. Fialho added <br /> that the obligations are currently being met and financed.
