interruptions to deliveries for causes beyond the control of DERWA may occur. In such <br /> cases and as requested by Pleasanton, DERWA shall make reasonable efforts to meet <br /> deliveries with supplemental water. Pleasanton shall pay the actual cost of any <br /> supplemental water deliveries made to Pleasanton at Pleasanton's request. <br /> SECTION 2: VAL VISTA PARK <br /> 2.1 The "Val Vista Point of Delivery" shall remain as configured as of the date of <br /> this Amendment One, shall not be abandoned, and shall become permanent and <br /> integrated into the "Primary Point of Delivery" in accordance with Paragraph 4.1 of the <br /> Agreement. <br /> 2.2 DERWA shall own all the components of the Val Vista Point of Delivery, <br /> including the portion of the pipeline located on DSRSD property. Pleasanton shall be <br /> responsible for 100% of replacement costs associated with Val Vista Point of Delivery. <br /> 2.2.1 Replacement Expenditures for items with a cost of less than one <br /> hundred thousand dollars ($100,000) each shall be considered an operating <br /> cost incorporated into the annual Pleasanton rate structure in the Fiscal Year <br /> in which DERWA makes such expenditures; and <br /> 2.2.2 Replacement Expenditures for items with a cost greater than one <br /> hundred thousand dollars ($100,000) shall be considered a capital cost. <br /> Except in an emergency, DERWA will provide sixty (60) day notice of <br /> anticipated expenditures greater than one hundred thousand dollars <br /> ($100,000). Pleasanton shall reimburse DERWA the actual cost of the <br /> expenditure within 30 days of receipt of invoice. <br /> 2.2.3 Replacement costs shall include relocation if required to <br /> accommodate operation of the DSRSD Regional Treatment Facilities. <br /> 2.3 Within 30 days of the effective date of this Amendment One, Pleasanton shall <br /> pay DERWA a lump sum of fifty-seven thousand, two hundred dollars ($57,200) for the <br /> capital buy-in to DERWA Reservoir R100 that will benefit Pleasanton recycled water <br /> service to Val Vista Park. <br /> 2.4 Upon the effective date of this Amendment One: <br /> 2.4.1 Pleasanton shall reimburse DERWA one percent (1.0%) of the <br /> DERWA Replacement Expenditures for items with a cost of less than <br /> one hundred thousand dollars ($100,000) each and associated with <br /> Reservoir R100, in the Fiscal Year in which DERWA makes such <br /> expenditures; and <br /> Page 4 of 7 <br />
