ATTACHMENT 2 <br /> AMENDMENT ONE TO AGREEMENT TO PROVIDE RECYCLED <br /> WATER TREATMENT AND DELIVERY SERVICES <br /> By and between DERWA and the CITY OF PLEASANTON <br /> This Amendment One is entered into this day of , 2015, by and <br /> between the DSRSD-EBMUD Recycled Water Authority, a joint powers authority <br /> organized and existing under Government Code sec. 6500 et seq. (hereinafter"DERWA") <br /> and the City of Pleasanton, a California municipal corporation (hereinafter "Pleasanton" <br /> or "City"), for the purpose of further defining the terms and conditions under which <br /> DERWA will provide Recycled Water treatment and delivery services to the City of <br /> Pleasanton. <br /> RECITALS <br /> WHEREAS, DERWA and Pleasanton entered into an Agreement to Provide <br /> Recycled Water Treatment and Delivery Services ("Agreement') dated January 7, 2014; <br /> and <br /> WHEREAS, Pleasanton has completed planning and design of the Pleasanton <br /> Recycled Water Infrastructure Expansion Project; and <br /> WHEREAS, DERWA and Pleasanton anticipated locating the Pleasanton's"Primary <br /> Point of Delivery" ("Pleasanton Turn Out") near the DERWA treatment facilities; and <br /> WHEREAS, the Parties agree locating the Pleasanton Turn Out one thousand five <br /> hundred (1,500) feet downstream of the treatment plant on DERWA "Pipeline AB" <br /> reduces the disruption and impact to the DERWA treatment facilities but increases <br /> DERWA operating cost for power. and <br /> WHEREAS, locating the Pleasanton Turn Out further along Pipeline AB reduces City <br /> capital cost; and <br /> WHEREAS, maintaining the existing "Val Vista Point of Delivery" eliminates future <br /> utility access issues into the Dublin San Ramon Services District ("DSRSD") Regional <br /> Treatment Facilities; and <br /> WHEREAS, maintaining the existing "Val Vista Point of Delivery" reduces City <br /> capital cost; and <br /> WHEREAS, the parties wish to enter into this Amendment One to implement the <br /> facilities configuration identified during planning and design of the Pleasanton Recycled <br /> Water Infrastructure Expansion Project to the mutual benefit of both parties. <br /> NOW, THEREFORE, in consideration of these Recitals and the terms, conditions <br /> and covenants contained herein, it is mutually understood and agreed as follows: <br />
