does not see a play structure for K-8 students in the park area currently. She asked if it is restricted in
use.
Mr. Weinstein responded it will not be restricted to use. The gate to the park to the public right-of-way to
Iron Horse Trail will be open. The school itself has recreational amenities on site, a playground on site
and open space the school plans to use. There was not a desire to accommodate play structures on
this site so the applicant team designed the park mainly to accommodate recreational needs of
residents in the vicinity and intended to be a passive park where people could picnic in and play ball or
catch.
Vice-Mayor Brown asked and confirmed that the gate could accommodate students of the Montessori
West School who could walk students down as well as residents, to use the park.
Vice-Mayor Brown said her understanding is the density of the homes is very narrow under the PUD.
She asked if the area from the house to the side yard is 3 feet and voiced opposition for this amount of
space given the need for garbage cans and walking space. Mr. Weinstein said they will operate
functionally well. The side setbacks range down to 5 feet and the rear setbacks range down to 8 %feet
which might have been adjusted slightly with revisions. It is a relatively tight site design and something
that work find in terms of residents using their yards. Others might desire a larger back, side or front
yard, but this is not dramatically different from other projects seen in the City.
Vice-Mayor Brown said if the church relocates and goes to another area in Pleasanton, she said their
relocation must be taken into consideration and Mr. Weinstein confirmed this is taken into account.
Councilmember Narum referred to conditions of approval number 15 which states "This conditional use
permit shall lapse and become void one year if there is no building permit." She asked if this refers to
having to build the third building for the school. Mr. Weinstein said the City wants projects to start in a
timely manner. The fear is that applicants might hold onto their approvals and conditions have changed,
so this condition is meant to move the project forward including operational changes the school is
requesting.
Councilmember Narum said the City has conditioned the school to conduct traffic and parking studies,
given the concern of the school enrollment up to 294 students. She voiced concerns with requiring the
school to be built within one year to keep their CUP.
Community Development Director Beaudin explained that this relates to executing the 120 student
school opportunity and any improvements that would have to be built as part of that project, such as
parking lot, tenant improvements or site modifications and not related to the larger school application.
Councilmember Narum suggested the condition be clarified a bit.
Councilmember Narum asked and confirmed with Mr. Beaudin that the City is allowed to approve 4
General Plan Amendments per element per year and that there have been one or two GPAs thus far
this year and staff monitors this.
Councilmember Pentin asked and confirmed the limit is 4 GPAs in a calendar year.
Councilmember Olson said he would like to be sure the project is conditioned such that the HOA which
is formed here is going to have to be responsible for some of the maintenance activity on Ironwood
Drive. Mr. Weinstein said HOA discussion is a private party discussion and he knows the developer is
interested and has begun this dialogue. The City is not making it a requirement for this project given
how the project is presented and what is being requested of the City and this process. Mr. Fialho added
that the obligations are currently being met and financed. As to whether or not there is any relief on the
adjoining HOAs and this newly formed HOA is a private transaction that occurs assuming the PUD is
approved and constructed.
City Council Minutes Page 8 of 28 October 6, 2015
