ATTACHMENT 1 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AMENDING CHAPTER 18.20 (DESIGN REVIEW) OF THE PLEASANTON MUNICIPAL CODE, AS FILED UNDER CASE P15-0384 WHEREAS, based in part on recommendations of the Historic Preservation Task Force, at its meeting of November 18, 2014, the City Council directed staff to initiate a Municipal Code amendment to expand design review authority for "historic" single-family homes in the Downtown Specific Plan Area; and WHEREAS, on October 14, 2015, the Planning Commission held a public hearing on the proposed amendment to the Pleasanton Municipal Code and recommended that the City Council approve the amendment to Chapter 18.20 (Design Review) to require Administrative Design Review approval for certain exterior changes to single-family homes in residential zoning districts within the Downtown Specific Plan Area that are determined to be historic resources; and WHEREAS, a duly noticed public hearing was held before the City Council on November 3, 2015, at which time the City Council reviewed the report of the Director of Community Development regarding the proposed amendment to the Pleasanton Municipal Code, and considered all related reports, documents, testimony, and the recommendation of the Planning Commission; and WHEREAS, at the same November 3, 2015 meeting the City Council accepted the historic resource survey prepared by Architectural Resources Group (August 2015), from which some of the historic residential structures subject to this expanded design review authority were determined. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council finds that the proposed amendment to the Pleasanton Municipal Code regarding design review within the Downtown Specific Plan Area is consistent with the Pleasanton General Plan, and that this amendment will not cause a significant effect on the environment as provided in Title 14 of the California Code of Regulations Section 15061(b)(3). SECTION 2. The Pleasanton Municipal Code is hereby amended as set forth in Exhibit A, attached hereto and incorporated herein by reference. SECTION 3. A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times", a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's Office within fifteen (15) days after its adoption. SECTION 4. This ordinance shall be effective thirty (30) days after its passage and adoption.
