Box 520 <br /> Pleasanton, CA 94566 <br /> Recording requested Pursuant to <br /> Government Code Sections <br /> 27383&6103 <br /> PREANNEXATION AND PROVISION OF WATER AND SEWERAGE <br /> FACILITIES AND SERVICE AGREEMENT <br /> THIS AGREEMENT is made this 6t" day of October, 2015 between the City of <br /> Pleasanton, a municipal corporation (City) and Kamil and Nadereh Navai (Owners). <br /> RECITALS <br /> A. Owners are the owners of certain real property located at APN 949-0007-016-02, <br /> Pleasanton, CA, more particularly described in Exhibit A (the Property) and <br /> incorporated herein by reference. <br /> B. Owners wish to connect the Property to the City sewer system in order to meet <br /> Alameda County Department of Environmental Health's requirement to connect <br /> to City sewer to accommodate one new home on their property. Alameda <br /> County Department of Environmental Health restricts repairs or installation of <br /> new septic systems when a sanitary sewer main is within 200 feet of the <br /> property. <br /> C. Owners also seek to connect the Property to the City's water system. <br /> D. Generally, City policy requires property to be annexed prior to extending such <br /> City utility services. <br /> E. Owners are willing to annex the Property either as part of a larger annexation or <br /> as part of a smaller annexation involving other property contiguous to the City. <br /> F. The public health, safety, and welfare of the City's residents are well served by <br /> eliminating the need for water wells and septic tanks and by connecting to the <br /> City's water and sewer system. <br /> G. City is willing to extend its water and sewer services only if there are assurances <br /> that the Property will not be further subdivided without approval of the City, water <br /> and sewer service is only being provided to one (1) new home and any building <br /> additions on the Property are subject to City review and approval of the design <br /> for any such additions. <br /> NOW, THEREFORE, City and Owners hereby agree as follows: <br />
