ATTACHMENT 1 RESOLUTION NO. 15-XXXX A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING A PRE-ANNEXATION AGREEMENT AND REQUEST FOR WATER AND SEWER CONNECTIONS FOR APN 949-0007-016-02 (KAMIL AND NADEREH NAVAI) WHEREAS, at the meeting of October 6, 2015, the City Council received a report from the Director of Community Development regarding the request from Kamil and Nadereh Navai for water and sewer connections for their property on Sycamore Road (APN 949-0007-016-02), in unincorporated Alameda County, where a sewer connection is needed to construct a new single family home; and WHEREAS, Government Code Section 56133 requires a city that wishes to provide utility service beyond its jurisdictional boundary to obtain approval from the Local Agency Formation Commission (LAFCo); and WHEREAS, the City Council adopted policies on December 3, 2002 regarding when to consider approval of water and sewer connections within the unincorporated Happy Valley, and the present request meets these criteria as it only provides utility service to one new home on an existing lot (and not provide utility service to any additional homes), the owners agree to vote in favor of future annexation, and the owners have agreed to be subject to City review of the design of the new home, as memorialized in the Pre-Annexation Agreement. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1: The City Council approves the request for water and sewer connection to one new home on the property at APN 949-0007-016-02 and authorizes execution of the Pre- annexation agreement with Kamil and Nadereh Navai. SECTION 2: The City Council directs staff to file an application with LAFCo for its consideration after Kamil and Nadereh Navai pay all required fees. SECTION 3: This resolution shall become effective immediately upon its passage and adoption. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on October 6, 2015.
