ORDINANCE NO. 2125 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> BANNING SMOKING IN CITY PARK AND RECREATION FACILITIES, <br /> INCLUDING CITY PARKING LOTS ADJACENT TO PARK AND RECREATION <br /> FACILITIES, BUT EXEMPTING THE OUTDOOR AREAS OF THE CALLIPPE <br /> PRESERVE GOLF COURSE, BY AMENDING MUNICIPAL CODE CHAPTERS <br /> 9.24 AND 13.08 <br /> WHEREAS, the City of Pleasanton has some existing restrictions regarding <br /> smoking in public and work places in Municipal Code Chapter 9.24, and Park and <br /> Recreation Facilities in Municipal Code Chapter 13.08, to support public health, safety <br /> and welfare; and <br /> WHEREAS, the Youth Commission and its Public Policy Subcommittee have <br /> been studying City parking restrictions and tobacco issues, and at its May 13, 2015 <br /> meeting voted to recommend a ban on smoking in City parks, trails and adjacent <br /> parking lots, to protect persons from second hand smoke exposure, limit carcinogen <br /> exposure from cigarette butt litter, and reduce fire danger from improper cigarette <br /> disposal; and <br /> WHEREAS, the Parks and Recreation Commission at its May 14, 2015 meeting <br /> recommended that the City Council adopt the Youth Commission's proposal; and <br /> WHEREAS, the Human Services Commission at its May 20, 2015 meeting <br /> recommended that the City Council adopt the Youth Commission's proposal. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. It finds that the proposed smoking ban would reduce cigarette butt <br /> litter, decrease fire danger and improve air quality, and therefore qualifies as a <br /> categorical exemption from the California Environmental Quality Act pursuant to 14 <br /> C.C.R. § 15308. <br /> SECTION2. It adopts the municipal code amendments in the attached Exhibit A. <br /> SECTION 3. A summary of this ordinance shall be published once within <br /> fifteen (15) days after its adoption in "The Valley Times", a newspaper of general <br /> circulation published in the City of Pleasanton, and the complete ordinance shall be <br /> posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br /> adoption. <br /> SECTION 4. This ordinance shall be effective thirty (30) days after its passage <br /> and adoption. <br /> 1 <br />
