1. The Operation and Maintenance Agreement shall clarify that the property owner(s) of <br /> the site shall be responsible for the following in perpetuity: <br /> a. Maintaining all private stormwater treatment measures on the project site. <br /> b. Annually submitting a maintenance report to the City Operations Services <br /> Department, Utilities Division, addressing the implementation of the <br /> Operation and Maintenance Agreement requirements. <br /> The final signed and notarized Operation and Maintenance Agreement shall be <br /> submitted to the Engineering Division prior to project receiving final discretionary <br /> approval by the Zoning Administrator, Planning Commission, or City Council. The <br /> Agreement is subject to review and approval of the City Engineer/City Attorney, prior <br /> to recordation. <br /> 2. The Operation and Maintenance Agreement responsibilities shall include, but not be <br /> limited to the following: <br /> a. Repainting text near the drain inlets to state "No Dumping— Drains to Bay." <br /> b. Ensuring maintenance of landscaping with minimal pesticide and fertilizer <br /> use. <br /> c. Ensuring no one disposes of vehicle fluids, hazardous materials or rinse <br /> water from cleaning tools, equipment or parts into storm drains. <br /> d. Cleaning all on-site stormdrain at least twice a year with one cleaning <br /> immediately prior to the rainy season. The City may require additional <br /> cleanings. <br /> e. Sweeping regularly but not less than once a month, driveways, sidewalks and <br /> paved areas to minimize the accumulation of litter and debris. Corners and <br /> hard to reach areas shall be swept manually. Debris from pressure washing <br /> shall be trapped and collected to prevent entry into the storm drain system. <br /> Wastewater containing any soap, cleaning agent or degreaser shall not be <br /> discharged into the storm drain. <br /> f. Mowing and removing clippings from vegetated swales with grasses on a <br /> regular basis. <br /> 27 <br />
