ATTACHMENT 1 RESOLUTION NO. 15-XXXX A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING A PRE-ANNEXATION AGREEMENT AND REQUEST FOR WATER AND SEWER CONNECTIONS FOR 753 SYCAMORE ROAD (ROBIN BOGGS AND CARMEN JUNG) WHEREAS, at the meeting of August 18, 2015, the City Council received a report from the Director of Community Development regarding the request from Robin Boggs and Carmen Jung for water and sewer connections for their residence at 753 Sycamore Road, in unincorporated Alameda County, where a sewer connection is needed to expand the square footage of the residence and the owners are requesting approval for a future connection to the City water system; and WHEREAS, Government Code Section 56133 requires a city that wishes to provide utility service beyond its jurisdictional boundary to obtain approval from the Local Agency Formation Commission (LAFCo); and WHEREAS, the City Council adopted policies on December 3, 2002 regarding when to consider approval of water and sewer connections within the unincorporated Happy Valley, and the present request meets these criteria as it involves an existing lot where subdivision is not requested, the owners agree to vote in favor of future annexation, and the owners have agreed to be subject to City review of the design of the addition, as memorialized in the Pre-Annexation Agreement. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1: The City Council approves the request for water and sewer connection to the residence at 753 Sycamore Road and authorizes execution of the Pre-annexation agreement with Robin Boggs and Carmen Jung. SECTION 2: The City Council directs staff to file an application with LAFCo for its consideration after Robin Boggs and Carmen Jung pay all required fees. SECTION 3: This resolution shall become effective immediately upon its passage and adoption. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on August 18, 2015.
