PUBLIC NOTICE <br /> Notices of this appeal were sent to surrounding property owners and tenants within a <br /> 1,000-foot radius of the site. Staff has provided the location and noticing maps as <br /> Attachment 5, Exhibit G for reference. At the time this report was published, staff had <br /> received no public comments regarding this notice. <br /> ENVIRONMENTAL ASSESSMENT <br /> This project is categorically exempt (Section 15301 (e), Class 1, Existing Facilities) from <br /> the requirements of the California Environmental Quality Act (CEQA). Therefore, no <br /> environmental document accompanies this report. <br /> CONCLUSION <br /> Staff believes the Planning Commission action to modify the Zoning Administrator <br /> determination, which approved the project as proposed and subject to the same <br /> conditions of approval, but denied the second-floor balcony portion of the Kiziloglu's <br /> request, is appropriate and will result in a project that adequately mitigates the privacy <br /> concerns expressed by the Cummings during both the Zoning Administrator and <br /> Planning Commission hearings. Therefore, staff recommends that the City Council <br /> adopt the attached resolution denying the Kiziloglus' appeal, thereby upholding the <br /> decision of the Planning Commission to approve the project as proposed without the <br /> second-floor balcony, subject to the same conditions of approval, except that all <br /> references to the second-floor balcony shall be removed from Condition of Approval #7 <br /> (Attachment 4). <br /> Submitted by: Approved by: <br /> Gerry Beaudin Nelson Fialho <br /> Director of Community City Manager <br /> Development <br /> Attachments: <br /> 1.
