ATTACHMENT 1 <br /> RESOLUTION NO. 15- <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DENYING THE APPEAL OF KURSAD AND ZARINA KIZILOGLU, THEREBY <br /> UPHOLDING THE PLANNING COMMISSION'S DETERMINATION TO MODIFY THE <br /> ZONING ADMNINISTRATOR'S DETERMINATION TO APPROVE AN <br /> ADMINISTRATIVE DESIGN REVIEW APPLICATION AT 5196 HUMMINGBIRD ROAD <br /> TO: (1) CONSTRUCT AN APPROXIMATELY 297-SQUARE-FOOT SINGLE-STORY <br /> ADDITION WITHOUT THE SECOND-FLOOR BALCONY ON THE REAR OF THE <br /> RESIDENCE; (2) CONSTRUCT AN APPROXIMATELY 558-SQUARE-FOOT <br /> SECOND-FLOOR ADDITION ABOVE THE GARAGE ON THE EAST SIDE OF THE <br /> RESIDENCE; (3) INSTALL FIVE NEW DORMER WINDOWS; (4) INSTALL A NEW <br /> ROOF OVER THE FRONT PORCH; AND (5) INSTALL NEW SECOND-FLOOR <br /> WINDOWS AND DOORS WITHOUT THE PROPOSED SECOND-FLOOR BALCONY <br /> AND SUBJECT TO THE SAME CONDITIONS OF APPROVAL, AS FILED UNDER <br /> CASE NOS. P15-0037. <br /> WHEREAS, Kursad and Zarina Kiziloglu applied for Administrative Design <br /> Review approval at 5196 Hummingbird Road to: (1) construct an approximately 297 <br /> square-foot single-story addition with an open-sided second-floor balcony on the rear of <br /> the residence; (2) construct an approximately 558 square foot second-floor addition <br /> above the garage on the east side of the residence; (3) install five new dormer windows; <br /> (4) install a new roof over the front porch; and (5) install new second-floor windows and <br /> doors; and <br /> WHEREAS, zoning for the property is R-1-6,500 (One-Family Residential) <br /> District and the proposed project is subject to Administrative Design Review pursuant to <br /> the Pleasanton Municipal Code; and <br /> WHEREAS, after receiving a staff presentation and public testimony, the Zoning <br /> Administrator approved the project as proposed, subject to conditions of approval at a <br /> hearing on March 10, 2015; and <br /> WHEREAS, within the time specified by the Pleasanton Municipal Code, <br /> Jamison and Elizabeth Cummings submitted an appeal of the decision of the Zoning <br /> Administrator citing issues of privacy; skepticism that the trees would create an effective <br /> screen; maintenance concerns; and allergies created by the installation of new trees; <br /> and <br /> WHEREAS, at its May 27, 2015 meeting, after receiving a staff presentation and <br /> public testimony, the Planning Commission modified the Zoning Administrator's <br /> determination thereby approving the project as proposed and subject to the same <br /> conditions of approval, but denying the second-floor balcony portion of the Kiziloglu's <br /> request; and <br />
