Councilmember Pentin agreed that the proposed changes are positive all around. He maintained his
issue with access to the arroyo and specifically with the way the project was conditioned. He requested
a friendly amendment deleting the requirement for a major PUD modification to gain access to the
arroyo, if and when the time comes that either the city or Zone 7 provide a through trail from the north
side.
Vice Mayor Brown declined, stating that she would support the position of the Parkside community.
Councilmember Olson concurred.
Councilmember Narum said was pleased to see a for-sale project with reduced density that
simultaneously helps to alleviate some of the strain on traffic, schools and water. She said she also felt
the proposed project was more consistent with the zoning of the adjoining parcel, should it ever be
developed.
Councilmember Olson asked and staff confirmed that the 9 points on page 2 of the staff report are
included in the staff recommendation and motion.
Mayor Thome said he was pleased to see the departure from an apartment project, which the city has
been approving a lot of for the wrong reasons lately. He thanked the applicant for working so
cooperatively with the Parkside community.
MOTION: It was m/s by Brown/Narum to introduce and waive first reading of Ordinance No. 2121
approving Case PUD-81-30-89D, the application of SHAC Las Positas Apartments LLC for a PUD
development plan to construct 94 condominium units and related site improvements at 5850 West Las
Positas Boulevard; to introduce and waive first reading of Ordinance No. 2122 approving Case PUD-
81-30-55M, the application of SHAC Las Positas Apartments LLC for a PUD major modification for
Planned Unit Development (PUD) Major Modification to amend the Housing Site Standards and Design
Guidelines for Site #9 to specifically change the minimum and maximum density from the required 30
dwelling units/acre to 15.9 dwelling units/acre for the construction of 94 condominium units and related
site improvements at 5.9-acre site located at 5850 West Las Positas Boulevard; to introduce and waive
first reading of Ordinance No. 2123 approving a PUD Development Plan to construct 94 condominium
units and related site improvements as filed under Case No. P15-0170; to introduce and waive first
reading of Ordinance No. 2124 approving a first amendment to the Development Agreement; and to
adopt and waive full reading of Resolution No. 15-770 approving an Affordable Housing Agreement.
Motion passed by the following vote:
AYES: Councilmembers Brown, Narum, Olson, Mayor Thorne
NOES: Councilmember Pentin
ABSENT: None
23. Consider a request from MidPen Housing for an additional financial appropriation for the
development of the Kottinger Gardens affordable senior housing development (PUD-101) to be
located on Kottinger Drive
Mr. Bocian presented the staff report and a brief update on the project. As the Council may recall, a
Disposition and Development Agreement (DDA) was approved for this project which includes a $10
million loan from the city's Lower Income Housing Fund. This fund has a current balance of a little over
$16 million. Recently, the Department of Housing and Urban Development (HUD) approved the
application for disposition of the project, which clears the way for the demolition of Kottinger Place. The
Alameda County Housing Authority also approved a Project-Based Section 8 Housing Contract for 50
units.
City Council Minutes Page 14 of 18 June 16,2015
