RESOLUTION NO. 15-770 <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> APPROVING THE AFFORDABLE HOUSING AGREEMENT BETWEEN THE CITY OF <br /> PLEASANTON AND SHAG LAS POSITAS APARTMENTS LLC AS FILED UNDER <br /> CASE NO. PUD-81-30-89D <br /> WHEREAS, SHAC Las Positas Apartments LLC has made an application to the City for <br /> an Affordable Housing Agreement for the construction of a multi-family residential development <br /> located at 5850 West Las Positas Boulevard, filed under Case No. PUD-81-30-89D; and <br /> WHEREAS, the Pleasanton Housing Commission reviewed the Affordable Housing <br /> Agreement at its regular meeting on April 16, 2015; and <br /> WHEREAS, a duly-noticed public hearing was held by the City Council on June 16, <br /> 2015, at which time the public was given the opportunity to comment on the Affordable Housing <br /> Agreement; and <br /> WHEREAS, the City Council considered all the information presented at the public <br /> hearing regarding the terms of the Affordable Housing Agreement. <br /> NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds that the proposed Affordable Housing Agreement between the City of <br /> Pleasanton and SHAC Las Positas Apartments LLC is consistent with the City's General Plan and <br /> the objectives of the City's affordable housing polices. <br /> SECTION 2. Approves the Affordable Housing Agreement between the City of <br /> Pleasanton and SHAC Las Positas Apartments LLC, a copy of which is attached hereto as <br /> Exhibit A and incorporated herein by this reference; and authorizes the City Manager to execute <br /> the Affordable Housing Agreement in generally the form attached as Exhibit A, subject to minor <br /> amendments approved by the City Manager and City Attorney. <br /> SECTION 3. This resolution shall become effective immediately upon the effective date <br /> of the ordinances approving the PUD development plan and development agreement for this <br /> project. <br /> PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on June 16, 2015. <br /> I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on the 16th day of June <br /> 2015, by the following vote: <br /> Ayes: Councilmembers Brown, Narum, Olson, Mayor Thorne <br /> Noes: Council member Pentin <br /> Absent: None <br /> Abstain: None <br /> 1 <br />
