ORDINANCE NO. 2122 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATION OF SHAG LAS POSITAS APARTMENTS <br /> LLC FOR A PUD MAJOR MODIFICATION AS FILED UNDER CASE NO. P15- <br /> 0170 <br /> WHEREAS, SHAC Las Positas Apartments LLC has applied for Planned Unit <br /> Development (PUD) Major Modification to City Council Ordinance No. 2030 to modify <br /> the minimum density requirement of 30 dwelling units/acre to a density of 15.9 dwelling <br /> units/acre for the construction of 94 condominium units and related site improvements <br /> at 5.9-acre site located at 5850 West Las Positas Boulevard (the "Project"); and <br /> WHEREAS, zoning for the property is Planned Unit Development— Mixed Use <br /> (PUD-MU) District; and <br /> WHEREAS, the Planning Commission at its regular meeting on May 13, 2015 <br /> adopted Resolution PC-2015-09, determining that the proposed PUD major modification <br /> is appropriate for the site, making findings, and recommending to the City Council that <br /> Case No. P15-0170 be approved; and <br /> WHEREAS, on June 16, 2015, the City Council held a duly noticed public <br /> hearing on this application and considered all public testimony, agenda reports, related <br /> materials, and the recommendations of City staff and the Planning; and <br /> Commission; and <br /> WHEREAS, the City Council determined that the conditions described in <br /> California Environmental Quality Act (CEQA) Guidelines Section 15162 have not <br /> occurred and finds that the previously certified Supplemental Environmental Impact <br /> Report (SEIR), including the adopted CEQA Findings and Statement of Overriding <br /> Considerations in City Council Resolution 12-492, and the Addendum to the SEIR for <br /> the Project and SHAC (SummerHill Home) Las Positas Townhome Condominiums — <br /> CEQA Addendum Substantial Conformity memo, are adequate to serve as the <br /> environmental documentation for the Project and satisfy all the requirements of CEQA; <br /> and <br /> WHEREAS, the City Council finds that the proposed PUD development plan <br /> major modification is consistent with the City's General Plan and purposes of the PUD <br /> ordinance. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br />
