r <br /> 40 410 <br /> Section 2 . This variance is granted based upon the following <br /> findings : <br /> (1) That there are exceptional or extraordinary circum- <br /> stances surrounding the need for this variance in <br /> that Mr. Narron' s predecessor in interest had pre- <br /> viously located this fence without authorization by <br /> the City and Mr. Narron purchased the property not <br /> knowing of the existence of this illegal relocation <br /> of said fence into the required side yard. <br /> (2) The granting of this variance will not constitute a <br /> grant of special privilege to Mr. Narron, especially <br /> since he has a corner lot and as a result the amount <br /> of usable open space existing on his property is <br /> affected by the location of the fence along the re- <br /> quired property line . <br /> (3) The granting of this variance will not be detrimental <br /> to the public health, safety, welfare or materially <br /> injurious to properties or improvements in the <br /> vicinity, especially in light of a letter on file <br /> from Mrs . Charles Crawford indicating that they have <br /> no objections to the existence of the fence in its <br /> present location and have conformed their landscaping <br /> to the present side of the fence . In addition , it <br /> appears from a review of the site that the fence does <br /> not constitute a traffic hazard. <br /> Section 3 . The City Clerk is hereby directed to send a copy of <br /> this resolution to Mr. Lowell Narron . <br /> Section 4 .
