10 <br />ORDINANCE NO. 2121 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING THE APPLICATION OF SHAG LAS POSITAS APARTMENTS <br />LLC FOR PLANNED UNIT DEVELOPMENT (PUD) PLAN APPROVAL AS <br />FILED UNDER CASE PUD- 81- 30-89D <br />WHEREAS, SHAC Las Positas Apartments LLC has applied for PUD <br />development plan approval to construct 94 condominium units and related site <br />improvements at the property located at 5850 West Las Positas Boulevard (the <br />"Project "); and <br />WHEREAS, zoning for the property is Planned Unit Development — Mixed Use <br />(PUD -MU) District; and <br />WHEREAS, the Planning Commission at its regular meeting on May 13, 2015 <br />adopted Resolution PC- 2015 -10, determining that the proposed development plan is <br />appropriate for the site, making findings, and recommending to the Pleasanton City <br />Council that PUD- 81- 30 -89D be approved; and <br />WHEREAS, on June 16, 2015, the City Council held a duly noticed public <br />hearing on this application and considered all public testimony, agenda reports, and <br />related materials, and the recommendations of City staff and the Planning <br />Commission; and <br />WHEREAS, the City Council finds that the exceptions to the Housing Site <br />Development Standards and Design Guidelines as stated on pages 12 and 13 of the <br />May 13, 2015, Planning Commission staff report are appropriate; and <br />WHEREAS, the City Council determined that the conditions described in <br />California Environmental Quality Act (CEQA) Guidelines Section 15162 have not <br />occurred and finds that the previously prepared Supplemental Environmental Impact <br />Report (SEIR), including the adopted CEQA Findings and Statement of Overriding <br />Considerations in City Council Resolution 12 -492, and the Addendum to the SEIR for <br />the Project and SHAC (SummerHill Homes) Las Positas Townhome Condominiums — <br />CEQA Addendum Substantial Conformity memo, are adequate to serve as the <br />environmental documentation for the Project and satisfy all of the requirements of <br />CEQA; and <br />WHEREAS, the City Council finds that the proposed PUD development plan is <br />consistent with the City's General Plan and purposes of the PUD ordinance. <br />
