with Greenbriar Homes for Greenbriar to have the right to the other fifty (50) unused <br />sewer connections for the Greenbriar project currently under consideration. <br />As noted above, the Advance Sale Sewer permit was specific that sewer capacity was <br />purchased only for the sites listed, and could not be sold to third parties (unless the third <br />party was buying the listed site). This 1985 program's restrictions are consistent with <br />DSRSD's current policies that sewer capacity may not be transferred between different <br />properties. (For example, if a restaurant buys sewer capacity to operate on Hopyard, <br />then later wants to move to Santa Rita, the restaurant cannot move its sewer capacity <br />between the sites. The restaurant must buy new sewer capacity for its new Santa Rita <br />site.) Based on this DSRSD policy, it is recommended that the Lunds first receive <br />approval from DSRSD in a form acceptable to the City Manager before the Lunds be <br />allowed to sell and transfer their unused sewer capacity. <br />If the City Council were to approve such a gale and transfer, the attached resolution: <br />A. Requires DSRSD approval for any such transfers; <br />B. Requires the Lunds to execute documents memorializing the transfers; <br />C. Requires buyers to pay City sewer connection fees upon connection; and <br />D.
