She said she also felt <br />the proposed project was more consistent with the zoning of the adjoining parcel, should it ever be <br />developed. <br />Councilmember Olson asked and staff confirmed that the 9 points on page 2 of the staff report are <br />included in the staff recommendation and motion. <br />Mayor Thome said he was pleased to see the departure from an apartment project, which the city has <br />been approving a lot of for the wrong reasons lately. He thanked the applicant for working so <br />cooperatively with the Parkside community. <br />MOTION: It was m/s by Brown /Narum to introduce and waive first reading of Ordinance No. 2121 <br />approving Case PUD- 81- 30 -89D, the application of SHAG Las Positas Apartments LLC for a PUD <br />development plan to construct 94 condominium units and related site improvements at 5850 West Las <br />Positas Boulevard; to introduce and waive first reading of Ordinance No. 2122 approving Case PUD - <br />81-30-55M, the application of SHAC Las Positas Apartments LLC for a PUD major modification for <br />Planned Unit Development (PUD) Major Modification to amend the Housing Site Standards and Design <br />Guidelines for Site #9 to specifically change the minimum and maximum density from the required 30 <br />dwelling units /acre to 15.9 dwelling units/acre for the construction of 94 condominium units and related <br />site improvements at 5.9 -acre site located at 5850 West Las Positas Boulevard; to introduce and waive <br />first reading of Ordinance No. 2123 approving a PUD Development Plan to construct 94 condominium <br />units and related site improvements as filed under Case No. P15 -0170; to introduce and waive first <br />reading of Ordinance No. 2124 approving a first amendment to the Development Agreement; and to <br />adopt and waive full reading of Resolution No. 15 -770 approving an Affordable Housing Agreement. <br />Motion passed by the following vote: <br />AYES: Councilmembers Brown, Narum, Olson, Mayor Thorne <br />NOES: Councilmember Pentin <br />ABSENT: None <br />23. Consider a request from MidPen Housing for an additional financial appropriation for the <br />development of the Kottinger Gardens affordable senior housing development (PUD -101) to be <br />located on Kottinger Drive <br />Mr. Bocian presented the staff report and a brief update on the project. As the Council may recall, a <br />Disposition and Development Agreement (DDA) was approved for this project which includes a $10 <br />million loan from the city's Lower Income Housing Fund. This fund has a current balance of a little over <br />$16 million. Recently, the Department of Housing and Urban Development (HUD) approved the <br />application for disposition of the project, which clears the way for the demolition of Kottinger Place. The <br />Alameda County Housing Authority also approved a Project -Based Section 8 Housing Contract for 50 <br />units. <br />The project developer, MidPen Housing, is now poised to submit its 9% Low Income Housing tax Credit <br />(LIHTC) application which is a critical source of funding to the project at this time. This process is very <br />competitive with an anticipated application to approvals ratio of 3 to 1.
