S 0 • <br /> I <br /> Sec . 2 .26 Public Agency . Public agency includes any state agency , <br /> board or commission and any local or regional agency , as <br /> defined herein . It does not include the courts of the • <br /> State . This term does not include agencies of the federal <br /> government .. <br /> Sec . 2 .27 Responsible Agency . Responsible agency means the public <br /> agency which proposes to undertake or approve a project , <br /> and is responsible for making a Negative Declaration or <br /> for the preparation of an EIR. <br /> 1 Sec. 2 . 28 Significant Effect . Significant effect means a substantial <br /> as opposed to trivial impact on the environment . <br /> tArticle 3 <br /> General Responsibilities <br /> Sec . 3. 1 Fees . <br /> (a) Where the City is preparing an EIR 'Tor projects to be <br /> carried out by some entity other than the City itself, <br /> it shall charge and collect a reasonable fee from such <br /> person or entity , in order to recover the estimated <br /> costs incurred if preparing the EIR. <br /> • <br /> (b) The City may charge and collect a fee . members of <br /> the public for the actual cost of reproducing a copy <br /> of an EIR requested by the member of the public . <br /> Article 14 <br /> Application of the Act to Projects <br /> Sec . 4 .1 General Rule . The requirements set forth herein apply to <br /> projects which may have a significant effect on the envir- <br /> onment and which involve discretionary action by the City . <br /> Where it is clear that the activity in question will not <br /> 1 have a significant effect on the environment , the activity <br /> is not covered by the requirements set forth in CEQA, and <br /> these Guidelines concerning the evaluation of projects and <br /> the preparation and review of environmental impact reports <br /> shall not apply . <br /> Sec . 4 .2 State and Local Agency Projects ( Public Projects) . <br /> ( a) When the City plans to carry out a project which may <br /> have a significant effect on the environment , it shall <br /> prepare an EIR through its own efforts or though <br /> contract . <br /> 1 -6- <br />
