i
1
1 Sec. 4 . 4 Obligations of a Lead Agency.
( a) Where the City is acting as a lead agency it shall
meet all obligations for which a responsible agency
1 is responsible , eluding the determination of, whether
the project will or will not have a signficanteff'ect
on the environment and shall prepare or cause to be
i prepared the EIR or Negative Declaration after con-
sultation with all other public agencies which must
approve the project in question or a part of the
i project . To insure that the EIR or Negative Declara-
tion reflects the concerns of all the public agencies
involved, the City shall consult with public agencies
which will issue approvals for the project at an
iearly stage in development of the EIR.
(b) A Lead Agency shall include in its Notice of Completion
ia statement to the effect that it is a Lead Agency .
( c) The EIR prepared by the Lead Agency shall be consid-
ered i by every public agency prior to its approval or
disapproval of the project .
Sec . 4 .5 Subsequent EIR. Where an EIR has been prepared, no addition-
, al EIR need be prepared unless : •
(a) Substantial changes are proposed in the project which
will require major revisions of the EIR, due to the
involvement of new environmental impacts not consid-
ered in the original EIR;
i (b ) There are substantial changes with respect to the
circumstances under which the project is to be under-
taken, such as a change in the proposed location of
i the project , which will require major revisions in
the EIR due to the involvement of new environmental
impacts not covered in the original EIR.
Sec . 4 .6 Use of a Single EIR. The City may employ a single EIR to
describe more than one project , if such projects are essen-
tially the same in terms of environmental impact . Further,
i it may use an earlier EIR prepared in connection with an
earlier project to apply to a later project , if the circum-
stances of the projects are essentially the same . It may
i elect to write EIR' s in advance for entire programs or
regulations , in order to be prepared for project applications
to come . Whenever it chooses to utilize any of these alter-
s natives , however, it must find that the environmental effects
of the projects are similar enough to warrant the same
treatment in an EIR and that the EIR will adequately cover
the impacts of any single project . If these tests are not
i met , it should amend the EIR it prepares to a program to
apply it to an individual project with unusual characteristics ,
-8-
