1. The period of the Annual Alameda County Fair; <br /> 2. The period of live Horse Racing; and <br /> 3. Any current or future events where the entire lot will be required to facilitate parking for major <br /> events at the Fairgrounds. <br /> C. As a condition of its licensed use of the parking lot,FAIRGROUNDS shall operate and maintain the parking <br /> lot in accordance with the following requirements: <br /> 1. The areas to be maintained shall include the access to the station from the public road facilities. <br /> 2. FAIRGROUNDS shall arrange and pay for all utilities. Lighting will be provided only during <br /> hours of darkness during station operation. Burned out lights will be replaced within a two week <br /> period of bum out. The exterior of all light fixtures will be dusted three(3)times per year. Light <br /> fixtures will be washed annually. <br /> 3. Trash and litter shall be picked up weekly from access and parking areas. Access roads and <br /> parking areas shall be swept every two weeks. Signage shall be spot cleaned and washed <br /> annually. Painted surfaces shall be inspected annually for deterioration,and spot-repaired based <br /> upon the results of the inspection. Painted surfaces shall be repainted at least every 10 years. <br /> 4. Trash receptacles shall be emptied prior to overflow,and at least weekly. Trash receptacle liners <br /> shall be replaced as needed. <br /> 5. Landscaping shall be adequately watered, fertilized, weeded, and kept free of trash and litter. <br /> Litter and trash shall be picked up weekly in landscaped areas. The irrigation system shall be <br /> maintained in good working order. <br /> 6. FAIRGROUNDS shall arrange for graffiti removal. <br /> 7. FAIRGROUNDS shall provide security when in its sole judgment its use of the parking lot <br /> necessitates security service, but shall otherwise not be required to provide security for the <br /> parking lot. It is understood and acknowledged between the parties that PLEASANTON Police <br /> Department will provide first response. <br /> D. The FAIRGROUNDS at its sole discretion, reserves the right to charge for parking in said parking lot, <br /> including but not limited to charging: ACE patrons, Fair Patrons, Fairgrounds Event Patrons, the general <br /> public, other transit uses or other special uses. <br /> E. The FAIRGROUNDS and PLEASANTON will financially support the future repair, as necessary, of the <br /> parking lot by means of resurfacing. Resurfacing shall include all maintenance activities associated with <br /> extending the service life of the pavement surface.As mutually agreed upon by both parties,resurfacing may <br /> involve isolated full depth pavement section repairs,a pavement overlay,and/or a slurry seal,and pavement <br /> striping and marking shall be considered to be included after the pavement surface maintenance unless the <br /> parties mutually agree any such item of work is unnecessary. The percentage of contribution for the <br /> resurfacing will be 75%from PLEASANTON and 25% from the FAIRGROUNDS. The parties anticipate <br /> resurfacing shall be required approximately every 10 years. For purposes of this section"parking lot"means <br /> the entire Alameda County Fairgrounds Parking Lot, and not just that portion owned by ALAMEDA <br /> COUNTY. <br /> F. FAIRGROUNDS shall save, defend and hold harmless the County of Alameda, its Board of Supervisors, <br /> officers,employees and agents,and the City of Pleasanton, its City Council,officers,employees and agents <br /> from any and all claims,liabilities,damages,charges or penalties whether arising in litigation,administrative <br /> proceedings or otherwise("Liabilities"),arising out of,pertaining to or related to FAIRGROUNDS operation <br />
