Trafficking <br /> Victims Protection Act of 2000. <br /> 8. Contractors, Subcontractors, Debarment and Suspension, Executive Order 12549; 2 CFR Part <br /> 180; 2 CFR Part 1532. The Recipient shall not subcontract with any party who is debarred or <br /> suspended or otherwise excluded from or ineligible for participation in federal assistance <br /> programs under Executive Order 12549, "Debarment and Suspension". The Recipient shall not <br /> subcontract with any individual or organization on USEPA's List of Violating Facilities. (40 CFR, <br /> Part 31.35, Gov. Code 4477) <br /> The Recipient certifies to the best of its knowledge and belief, that it and its principals: <br /> (a) Are not presently debarred, suspended, proposed for debarment, declared ineligible, or <br /> voluntarily excluded by any federal department or agency; <br /> (b) Have not within a three(3)year period preceding this Agreement been convicted of or had a <br /> civil judgment rendered against them for commission of fraud or a criminal offense in <br /> connection with obtaining, attempting to obtain, or performing a public (federal, state or local) <br /> transaction or contract under a public transaction; violation of federal or state antitrust <br /> statutes or commission of embezzlement, theft,forgery, bribery, falsification or destruction of <br /> records, making false statements, or receiving stolen property; <br /> (c) Are not presently indicted for or otherwise criminally or civilly charged by a governmental <br /> entity(federal, state or local)with commission of any of the offenses enumerated in <br /> paragraph (b)of this certification; and <br /> (d) Have not within a three(3)year period preceding this application/proposal had one or more <br /> public transactions(federal, state or local)terminated for cause or default. <br /> Suspension and debarment information can be accessed at http://www.sam.gov. The Recipient <br /> represents and warrants that it has or will include a term or conditions requiring compliance with <br /> this provision in all of its contracts and subcontracts under this Agreement. The Recipient <br /> acknowledges that failing to disclose the information as required at 2 CFR 180.335 may result in <br /> the termination, delay or negation of this Agreement, or pursuance of legal remedies, including <br /> suspension and debarment. <br /> 9. Anti-Lobbying Provisions (40 CFR Part 34) &Anti-Litigation Provisions (2 CFR 220, 225, or 230). <br /> The Recipient shall ensure that no funds under this Agreement are used to engage in lobbying of <br /> the federal government or in litigation against the United States unless authorized under existing <br /> law. The Recipient shall abide by 2 CFR 225 (OMB Circular A-87) (or, if not applicable, other <br /> parallel requirements), which prohibits the use of federal grant funds for litigation against the <br /> United States or for lobbying or other political activities. The Recipient agrees to submit <br /> certification and disclosure forms in accordance with these provisions. In accordance with the <br /> Byrd Anti-Lobbying Amendment, any Recipient who makes a prohibited expenditure under 40 <br /> CFR Part 34 or fails to file the required certification or lobbying forms shall be subject to a civil <br /> penalty of not less than $10,000 and not more than $100,000 for each such expenditure. The <br /> Recipient shall abide by its respective 2 CFR 200, 225, or 230, which prohibits the use of federal <br /> grant funds for litigation against the United States or for lobbying or other political activities. <br /> 10. Disadvantaged Business Enterprises (40 CFR Part 33). The Recipient agrees to comply with the <br /> requirements of USEPA's Program for Utilization of Small, Minority and Women's Business <br /> Enterprises.
