Where contractors are used, the Recipient shall not authorize construction to begin until each contractor has furnished a performance bond in favor of the Recipient in the following amounts: faithful performance (100%) of contract value; labor and materials (100%) of contract value. This requirement shall not apply to any contract for less than $20,000.00. 5.11 Compliance with Law, Regulations, etc. (a) The Recipient agrees that it will, at all times, comply with and require its contractors and subcontractors to comply with all applicable federal and state taws, rules, guidelines, regulations, and requirements. Without limitation of the foregoing, the Recipient agrees that, to the extent applicable, the Recipient will: K (1) Comply with the provisions of the adopted.environmental mitigation plan for the term of this Agreement; ' / \ N, (2) Comply with the State Water Board's/'olicy for Implemehting\the Clean Water State Revolving Fund;" (3) Comply with and require compliance with the list of state laws attached-as G; . , / (4) Comply with and require its contractors and subcontractors on the Project to comply with federal DBE requirements;"and (5) Comply with and require its contractors and subcontractors'to comply with the list of federal laws attached as Exhibit E. / 5.12 Conflict of Interest. „ The Recipient certifies thet'it, its officers,,directors, agents, representatives, and staff is in compliance with applicable state-and/or federal'conflict,of interest laws: 5.13 ,Damages for Breach Affecting Tax Exempt Status or Federal Compliance In the event that any breach of ariscof theprovisions of this Agreement by the Recipient shall result in the loss of tax exempt status for any bonds of the State or any subdivision or agency thereof, including Bonds issued on behalf,ofthe State Water Board. or'if'such breach shall result in an obligation on the part of the State or any subdivision or agency thereof to reimburse the federal government by reason of any arbitrage profits, the Recipient shall immediately reimburse the State or any subdivision or agency thereof in an amount equal to any damages paid by or loss incurred by the State or any subdivision or agency thereof due to such breach. N / In the event that any breach of any of the provisions of this Agreement by the Recipient shall result in the failure of Project Funds to be used pursuant to the provisions of this Agreement, or if such breach shall result in an obligation on the part of the State or any subdivision or agency thereof to reimburse the federal government, the Recipient shall immediately reimburse the State or any subdivision or agency thereof in an amount equal to any damages paid by or loss incurred by the State or any subdivision or agency thereof due to such breach. 5.14 Disputes.
