2. To reimburse developers who have constructed all or a portion of any of the Transportation Improvement Projects if such reimbursement qualifies for reimbursement 3. To pay for and/or reimburse costs of program development and ongoing administration of the TVTD Fee program. SECTION 7—Credit or Reimbursement for Developer-Constructed Projects A developer may be entitled to credit against the TVTD fee or to reimbursement from TVTD fees if the developer constructs all or a portion of one of the transportation improvement projects. Credit or reimbursement shall be provided in the manner set forth in the JEPA; provided, that the city manager has approved the construction by the developer of all or a portion of the transportation improvement project. SECTION 8—Refund a) A developer may be entitled to a refund of the TVTD Fee in such an event that the developer paid the TVTD Fee but was unable to move forward with the project and the development has ceased, the building permit has expired and no extensions have been granted, or if granted, the extensions have expired; as to a development for which the fee has been collected; provided that the claim for such a refund is filed no later than six months after the expiration date of the building permit, or any extension thereof as may have been approved by the city; or. b) A refund is specifically authorized by a resolution of the TVTC pursuant to the JEPA. SECTION 9—Effective Date This resolution shall become effective immediately. SECTION 10—Severability Each component of the TVTD Fee and all portions of this resolution are severable. Should any individual component of the TVTD Fee or other provision of this resolution be adjudged to be invalid and unenforceable, the remaining provisions shall be and continue to be fully effective, and the TVTD Fee shall be fully effective except as to that portion that has been adjudged to be invalid. SECTION 11. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions.
