Office have reviewed these documents and have found them to be in substantial <br /> compliance with the approved Vesting Tentative Map. <br /> DISCUSSION <br /> Proposed Improvements <br /> The proposed subdivision and improvements are compatible with the objectives, polices, <br /> land uses and programs specified in the General Plan and Vineyard Avenue Corridor <br /> Specific Plan. <br /> The development proposes the extension of Silver Oaks Lane from its terminus east of <br /> Tract 7399 to Old Vineyard Avenue as shown in Attachment 3 of this report. <br /> The Chrisman Property connects Tract 7399, Silver Oaks Lane, on the west side, and <br /> Tract 7240 (the Hahner Property), Rolling Hills Lane, on north side of Old Vineyard <br /> Avenue. <br /> The sanitary sewer main, storm drain system, and water main within the public right of <br /> way serving this project will be maintained and operated by the City. The water and sewer <br /> laterals, storm water bio swales, and the private driveways will be the responsibility of <br /> each property owner. <br /> Such subdivision improvements are required to be bonded to guarantee their <br /> construction. Chapter 19.24 of the Municipal Code (Final Map) provides that the bonds, <br /> inspection fees, and improvement agreement are required to be furnished prior to the City <br /> Council approval of the Final Map. The developer, KC Bello LLC (successor to Northstar) <br /> has requested to post the bonds, pay the inspection fees, and file the improvement <br /> agreement after the Final Map has been recorded, but before any construction starts. <br /> The Agreement for Final Map Approval Without Improvement Agreement or Bonds <br /> provides for 1) the deferral of these deliverables and 2) a rescission of the City Council <br /> approval of the Final Map if conditions of the agreement are not met. <br /> The property is currently owned by the Chrismans. Following City Council approval of, <br /> and prior to recordation of the Final Map, the Chrismans will convey the property to KC <br /> Bello LLC (KCB). KCB is unable to secure subdivision bonds since it does not currently <br /> own the property, however, they have formed a partnership with D.R. Horton to build the <br /> project and have provided a letter of commitment from Willis of Florida (insurance broker) <br /> stating that Liberty Mutual Insurance Company will commit to the issuance of subdivision <br /> bonds to D.R. Horton for Tract 7660. <br /> Prior to recordation of the Final Map, D.R. Horton will file a subdivision improvement <br /> agreement with the City and D.R. Horton and/or KCB will pay the inspection fees. Escrow <br /> requirements will be written and enforced such that the Final Map is approved, but not <br /> recorded until the required bonds and inspection fees are deposited into escrow. <br /> Page 3 of 4 <br />
