Attachment 2 <br /> SIXTH SUPPLEMENTAL AGREEMENT <br /> TO <br /> AGREEMENT FOR WASTEWATER DISPOSAL SERVICES <br /> This Sixth Supplemental Agreement (the "Agreement") made and entered into this <br /> day of , 2014, by and between the CITY OF PLEASANTON, a municipal <br /> corporation (City) and the DUBLIN SAN RAMON SERVICES DISTRICT, a public agency of the <br /> State of California (District or DSRSD); collectively the "Parties"; <br /> WITNESSETH: <br /> WHEREAS, the Parties entered into that certain Agreement entitled Agreement for <br /> Wastewater Disposal Services dated November 3, 1992, (hereinafter defined as the "Basic <br /> Agreement"), by which the Parties' obligations for wastewater treatment and disposal are <br /> provided; and <br /> WHEREAS, supplemental agreements may be made to the Basic Agreement pursuant to <br /> Paragraph 17 thereof; and <br /> WHEREAS, the Parties entered into that certain Supplemental Agreement entitled First <br /> Supplemental Agreement to Agreement for Wastewater Disposal Services dated September 2, <br /> 1997, (hereinafter referred to as the "First Supplemental Agreement") by which the Parties agreed <br /> to certain terms and conditions related to the District's Clean Water Revival Project (as defined in <br /> that First Supplemental Agreement) including but not limited to the Clean Water Revival Project's <br /> operation, allocation of disposal capacity credits, allocation of recycled water rights, allocation of <br /> recycling credits, temporary use of funds, recycling project limitations, environmental <br /> considerations, irrigation water and main basin considerations ; and <br /> WHEREAS, subsequently the Parties entered into the Second Supplemental Agreement in <br /> December of 2000, the Third Supplemental Agreement in November 2002, and the Fourth <br /> Supplemental Agreement in November 2009; and <br /> WHEREAS, the Parties entered into that certain Supplemental Agreement entitled Fifth <br /> Supplemental Agreement to Agreement for Wastewater Disposal Services dated January 7, 2014, <br /> (hereinafter referred to as the "Fifth Supplemental Agreement") by which the Parties agreed to <br /> certain terms and conditicns related to integrating the supply, operation and facilities of their <br /> respective Recycled Water Programs (as defined in the Fifth Supplemental Agreement) in a <br /> manner that is in the best interest of the parties as well as DERWA; and <br /> WHEREAS, in accordance with the terms and conditions of the Fifth Supplemental <br />
