CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> RESOLUTION NO. 74-102 <br /> RE: VACATING AND CLOSING A PORTION OF RAY STREET <br /> IN THE CITY OF PLEASANTON <br /> WHEREAS, due to the realignment of Ray Street, the City Council <br /> of the City of Pleasanton finds that the portion of Ray <br /> Street hereinafter described in Exhibit A and more <br /> particularly delineated on a map attached hereto as <br /> Exhibit B is not necessary for present or prospective <br /> public street purposes and should be vacated and closed <br /> to public use; and <br /> WHEREAS, pursuant to §1930 , et seq. , of the Streets and Highways <br /> Code, the City Council may summarily vacate the above <br /> portion of Ray Street, provided that said vacation does <br /> not eliminate access to adjoining property and reserves <br /> IIany public easements necessary in the vacated area; and <br /> WHEREAS, the above vacation will not affect any access to public <br /> property; and <br /> WHEREAS, utility easements or rights of a type described in §1934 <br /> of the Streets and Highways Code will be reserved in the ( <br /> said vacation; <br /> If NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> I RESOLVE AS FOLLOWS : <br /> 1 Section 1. Pursuant to the provisions of §1930 , et seq. , of the <br /> Streets and Highways Code, that portion of Ray Street, a <br /> public street, as described in Exhibit A attached hereto <br /> and made a part hereof , is hereby vacated, EXCEPTING AND <br /> RESERVING THEREFROM, pursuant to the provisions of §1934 <br /> of the Streets and Highways Code: City reserves and <br /> excepts from the abandonment the easement and right at <br /> any time or from time to time, to construct, maintain, <br /> operate, replace , remove and renew sanitary sewers and <br /> storm drains and appurtenant structures in, upon, over <br />
