CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 840 <br /> <br /> AN ORDINANCE REZONING APPROXIMATELY 10 ACRES OF LAND, LOCATED <br /> BETWEEN HOPYARD ROAD AND VALLEY AVENUE BEHIND ALPHA BETA <br /> SHOPPING CENTER AND INCLUDING BOTH SIDES OF THE FUTURE NORTH- <br /> WAY ROAD, FROM RM-1500 AND ~4-2500 (HIGH DENSITY RESIDENTIAL) <br /> DISTRICT TO PUD (PLANNED UNIT DEVELOPMENT) DISTRICT, AND <br /> APPROVING A DEVELOPMENT PLAN FOR THE PROPERTY, AND AMENDING <br /> THE ZONING MAP OF THE CITY OF PLEASANTON ACCORDINGLY (ZONING <br /> UNIT MAP #170) <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. Rezones the parcel of land approximately ten (10) acres in <br /> size owned by Morrison Homes, located between Hopyard Road and <br /> Valley Avenue behind the Alpha Beta Shopping Center and in- <br /> cluding both sides of the future Northway Road from RM-1500 <br /> and ~4-2500 (High Density Residential) District to PUD (Planned <br /> Unit Development) District, (as more particularly shown on <br /> Zoning Unit Map No. 170 attached hereto as Exhibit A and <br /> incorporated herein by reference) and approving a development <br /> plan for said property, subject to the following conditions: <br /> <br /> 1. That the development be substantially as shown on the <br /> development plan, Exhibit A, and the materials, colors <br /> and textures board, Exhibit B, on file with the Planning <br /> Department. <br /> <br /> 2. That in order to insure the City's ability to monitor the <br /> flow into the Sunol Boulevard Sewage Treatment Plant and <br /> to decrease the risk of malfunctions to that facility, the <br /> development shall be phased so that none of the units are <br /> occupied during calendar year 1977 and no more than 44 of <br /> the 78 units are occupied during the 1978 calendar year. <br /> In no event is applicant guaranteed the above specific units <br /> during 1978 or any subsequent year. Applicant acknowledges <br /> that its project is subject to any annual development <br /> regulation which the City may adopt. <br /> <br /> 3. That because of the project's location immediately adjacent <br /> to the Alpha Beta shopping center (and especially the <br /> Alpha Beta loading dock), a 7 ft. high wall or fence be <br /> constructed along the northwest property lines, Lots 55 <br /> through 65. <br /> <br /> 4. The City does not accept any land offered for dedication <br /> as part of Heatherlark Park north of the northeastern end <br /> of the rear property line (the 13' PL) of Lot 78; Morrison <br /> Homes shall either purchase that portion of Heatherlark <br /> Park shown as part of Northway Road on the development <br /> plan or provide park equipment or other park improvements <br /> in exchange for City's property; the amount of any payment <br /> or exchange of property is to negotiated between the <br /> developer (or successors) and the City prior to issuance <br /> of any building permit; the developer may have the property <br /> appraised at its expense. <br /> <br /> <br />
