Attachment 3 <br /> AGREEMENT BETWEEN <br /> THE TRI-VALLEY CONVENTION & VISITORS BUREAU <br /> AND THE CITY OF PLEASANTON TO <br /> ADMINISTER THE TRI-VALLEY TOURISM MARKETING DISTRICT <br /> THIS AGREEMENT, made and entered into this 5`h day of May, 2015, between <br /> the CITY OF PLEASANTON, a municipal corporation ("City"), and the TRI-VALLEY <br /> CONVENTION & VISITORS BUREAU, also called VISIT TRI-VALLEY, a non-profit <br /> corporation ("Corporation"); <br /> RECITALS <br /> WHEREAS, CITY and CORPORATION recognize that it is in the best interests of <br /> CITY and CORPORATION to promote tourism development; <br /> WHEREAS, Section 36600 et seq. of the Streets and Highways Code of the <br /> State of California (hereinafter "Code") authorizes City to establish or maintain a <br /> Tourism Business Improvement District ("District") to promote tourism; <br /> WHEREAS, lodging business owners within the Tri-Valley Area developed a <br /> management district plan (hereinafter "Plan") and submitted signed petitions in support <br /> of the Plan from owners paying more than 50% of the proposed assessments; <br /> WHEREAS, City requested consent from the Cities of Danville, Dublin and <br /> Livermore, and the Counties of Alameda and Contra Costa ("Consenting Agencies") to <br /> renew the Tri-Valley Tourism Marketing District within their jurisdictions; <br /> WHEREAS, Consenting Agencies passed resolutions granting consent to the <br /> City to renew the Tri-Valley Tourism Marketing District within their jurisdictions; <br /> WHEREAS, on February 17, 2015, the City Council adopted a Resolution of <br /> Intention (hereinafter "Resolution") to renew the Tri-Valley Tourism Marketing District for <br /> the purpose of providing lodging businesses within the District activities and services as <br /> described in the Plan and Resolution ("District Services"); <br /> WHEREAS, on May 5, 2015 the City Council introduced Ordinance No. <br /> renewing the Tri-Valley Marketing District and levying an assessment on lodging <br /> businesses within the District (hereinafter "Ordinance") effective July 1, 2015; <br /> WHEREAS, the District may be administered by the Corporation pursuant to a <br /> contract between the City and the Corporation as provided for in the Ordinance; <br /> WHEREAS, the Corporation represents lodging business owners within the <br /> District and possesses the capacity to provide District Services; <br /> Page I of 8 <br />
