April 21, 2015 Operation Services TITLE: DROUGHT UPDATE; OPTIONS FOR LOCAL EMERGENCY DECLARATION AND STAGE 3 MANDATORY REDUCTIONS; ADOPT ADDENDUM TO THE INITIAL STUDY/MITIGATED NEGATIVE DECLARATION FOR THE RECYCLED WATER PROJECT; AND INTRODUCE ORDINANCES ADDING: CHAPTER 14.06 REGULATION OF RECYCLED WATER USE, AND CHAPTER 14.20 RECYCLED WATER USE FOR LANDSCAPE IRRIGATION, TO THE MUNICIPAL CODE SUMMARY As the California drought enters its fourth year, this report provides: an update on projected water allocations; information about on-going water conservation; the need for continuation of the local emergency and Stage 3 mandatory water restrictions in light of the State mandate by Governor Brown on April 1, 2015, as well as excess use penalties (which had been suspended for 90 days from January 2015 to April 2015). The Council is also asked to adopt another Addendum to the Initial Study/Mitigated Declaration for the Recycled Water Project based on direction from the State Water Board's environmental review unit. In addition, this report introduces proposed recycled water ordinances regarding: 1) the regulation of recycled water use; and 2) when recycled water is to be used for landscape irrigation. RECOMMENDATION Staff recommends that the City Council: (a) continue the local emergency drought declaration; (b) maintain the Stage 3 mandatory reduction of 25%; (c) reinstate excess use penalties for customers who do not reduce water usage by 25% effective May 15, 2015 (2015 usage compared to 2013 usage); (d) adopt a resolution adopting another Addendum to the Initial Study/Mitigated Negative Declaration for the Recycled Water Project; (e) introduce an ordinance to add a new Chapter 14.06 Regulation of Recycled Water Use to the municipal code; and (f) introduce an ordinance to add a new Chapter 14.20 Recycled Water Use for Landscape Irrigation to the municipal code
