BACKGROUND <br /> On May 1, 2012, the City Council approved the Planned Unit Development (PUD) development <br /> plan approving the construction of a mixed-use high-density residential/commercial <br /> development and a 0.55-acre public park at the property located at the northern corner of <br /> Gibraltar Drive and Hacienda Drive. The developer, Essex, formally BRE, will dedicate the park <br /> property to the City and the City will be responsible for developing and maintaining the park. <br /> Please refer to the November 10, 2011 Planning Commission staff report and the meeting <br /> minutes excerpt in Attachment 2 for addition background information. <br /> At the time of Parks and Recreation Commission review and City Council approval, it was <br /> unknown that buildings would be developed over private utilities that service two adjacent sites, <br /> the Shaklee and Kaiser Properties. Given this information, the new residential development and <br /> park land layout were modified in order to limit the impacts of the private utility lines that service <br /> adjacent properties (please see Image 1 below). Essex applied for and received approval for a <br /> new park site and design through a PUD Minor Modification application in March of 2014. Staff <br /> and the applicant have worked closely over the last year to design a park with appropriate <br /> amenities that will have little to no impact on the private utility lines and feel that the proposal <br /> before the Commission matches the quality of the previously approved park. <br /> DISCUSSION <br /> Previously Approved Park Layout and Amenities <br /> The approved 0.55-acre public park was proposed at the southwest side of the project site, on <br /> the north side of Gibraltar Drive, and had a flag-shaped layout (see Image 1, below, or <br /> Attachment 3). The park was approved with an approximately 5,566 square-foot multipurpose <br /> grass area for sports activities and seasonal events, two separate play apparatus areas (one for <br /> ages 3-5 and one for ages 5-12) with shade sails, seating areas, trellises, barbeques, bike <br /> racks, and an open grass area (Image 2 and/or Attachment 3). <br /> Page 2 of 5 <br />
