BACKGROUND <br /> On June 19, 2001, the City Council approved PUD-06, an application by Centex Homes <br /> to subdivide 1887 Vineyard Avenue and two lots east of it (on an approximately 54.6- <br /> acre site) into 44 lots and three Vineyard Estate lots for the construction of new single <br /> family homes. The property is located between Vineyard Trail (Old Vineyard Avenue) <br /> and Vineyard Avenue, east of the Pleasanton Unified School District property. <br /> On July 10, 2002, the Planning Commission approved an application by Centex Homes <br /> for a Vesting Tentative Map (Tract 7385) to subdivide the property into 44 lots, three <br /> Vineyard Estate lots, two common area parcels, and the option of a future day care <br /> parcel or two additional lots. <br /> Centex Homes constructed the first phase of the Vesting Tentative Map 7385. Tract <br /> 8112 (The Reserve at Pleasanton) is the second and last phase of the Vesting <br /> Tentative Map, Tract 7385. All public and subdivision improvements for this sub- <br /> division have been constructed and are ready for acceptance. <br /> DISCUSSION <br /> Improvements Constructed <br /> This development constructed a new public street, Finch Place, a court off of Manoir <br /> Lane (formerly School Loop Road). It also constructed two private streets, Shotwell <br /> Court off of Manoir Lane, and Frog Hill Lane off of Finch Place, as shown in <br /> Attachment 1. <br /> The street, street lights, sanitary sewer main, storm drain and water main serving this <br /> project within the public street, Finch Place, will be maintained and operated by the City. <br /> The sanitary sewer main and water main within the two private streets will also be <br /> maintained and operated by the City. The street lights and storm drain system on <br /> Shotwell Court will be private and maintained by the home owners association (HOA) of <br /> Tract 8112. The private street Frog Hill Lane will be maintained by the HOA and the <br /> property owners of 1666 Frog Hill Lane (Roberts), as per the private agreement <br /> recorded at the Alameda County Recorder's Office on March 22, 2013 (series number <br /> 2013-107122). <br /> The storm water treatment areas on each lot will be the maintenance responsibility of <br /> the individual property owners. <br /> This development also created an estate lot which has a residential home constructed <br /> within the building envelope and vineyards that have been planted within the agricultural <br /> easement. A perpetual agricultural and open space conservation easement has been <br /> dedicated pursuant to the Vineyard Avenue Corridor Specific Plan and recorded at the <br /> Alameda County Recorder's Office on November 13, 2013. In addition, the Tri-Valley <br /> Conservancy has been named as an intended Third Party Beneficiary entitled to <br /> exercise all rights of Grantee (City) in accordance with the terms of the easement. The <br /> Tri-Valley Conservancy is a California nonprofit public benefit corporation whose <br /> primary purpose is the preservation, protection, or enhancement of land in its <br /> agricultural and/or open space condition in the Tri-Valley area of eastern Alameda <br /> County. <br /> Page 2 of 3 <br />
