b. Profits of Other Eligible Organizations. All <br /> proceeds derived for a bingo game shall be kept <br /> in a special fund or account and shall not be " <br /> commingled with any other fund or account. Such <br /> proceeds shall be used only for charitable purposes <br /> except as follows: <br /> <br /> (1) Such proceeds may be used for prizes. <br /> <br /> (2) A portion of such proceeds not to exceed <br /> 10% of the proceeds after the deduction for <br /> prizes, or FIVE HUNDRED DOLLARS ($500) per <br /> month, whichever is less, may be used for <br /> rental of property, overhead and administra- <br /> tive expenses. <br /> <br />Section 4-2.1812 Records and Inspection of Records. <br /> <br /> a. Records. The permittee shall keep detailed and <br /> accurate records of the income and expenses <br /> received and dispersed in connection with the <br /> operation, conduct, promotion and supervision of <br /> bingo games. <br /> <br /> b. Inspection. The City of Pleasanton by and through <br /> its authorized officers shall have the right to <br /> examine and audit such records at any reasonable <br /> time and the permittee shall keep such records _, <br /> open for inspection by the City. <br /> <br />Section 4-2.1813 Revocation. The Chief of Police may revoke a permit <br /> for any violation of the provisions of this article <br /> or any applicable law or regulation or any false, <br /> misleading or fraudulent statement of a material fact <br /> in the application for a permit. <br /> <br />Section 4-2.1814 Notice of Intent to Revoke - Immediate Suspension <br /> Hearing. If the Chief of Police determines that a <br /> permit shall be revoked, he shall serve on the permit- <br /> tee a notice of his intent with his reasons therefore. <br /> The notice shall provide for revocation of the permit <br /> seven (7) days after service of notice upon permittee <br /> unless the permittee requests a hearing before the <br /> Chief of Police prior to revocation. The Police Chief <br /> shall give at least five (5) days prior written notice <br /> of the time and place of said hearing to the per- <br /> mittee and shall issue his written decision with seven <br /> (7) days after the conclusion of the hearing. <br /> <br />Section 4-2.1815 Immediate Suspension. The Chief of Police, or his <br /> authorized representative, may immediately suspend a <br /> permit pending a hearing on revocation if he finds <br /> gross violations of this chapter or State Law, or <br /> finds that public is in immediate danger from con- <br /> tinued use of said permit. <br /> <br /> -4- <br /> <br /> <br />
