Master Contract No. 900973, Procurement Contract No. <br /> FIFTH AMENDMENT TO AGREEMENT <br /> This Fifth Amendment to Agreement ("Fifth Amendment") is made by the County <br /> of Alameda ("County") and City of Pleasanton, ("Contractor") with respect to that certain <br /> agreement entered by them on June 20, 2012 and that certain First, Second, Third and <br /> Fourth Amendments to Contract, (collectively referred to herein as the "Contract") <br /> pursuant to which Contractor provides operation and maintenance services of sewer and <br /> water systems to County. <br /> County and Contractor agree as follows: <br /> 1. For valuable consideration, the receipt and sufficiency of which are hereby <br /> acknowledged, County and Contractor agree to amend the Agreement in the <br /> following respects: <br /> a. Extend and increase the contract <br /> 2. Except as otherwise stated in this Fifth Amendment, the terms and provisions of <br /> this Amendment will be considered to be effective as of the date this Fifth <br /> Amendment is executed by the County ("Effective Date"). <br /> 3. The term of the Agreement is currently scheduled to expire on June 30, 2015. As <br /> of the Effective Date, the term of the Agreement is extended through June 30, <br /> 2016. <br /> 4. In consideration for Contractor's additional services, the County shall pay <br /> Contractor in an additional amount not to exceed one hundred eighty five thousand <br /> dollars ($185,000). As a result of these additional services the not to exceed <br /> amount has increased from One Million Three Hundred Fifty Thousand dollars <br /> ($1,350,000) to One Million Five Hundred Thirty Five Thousand dollars <br /> ($1,535,000) over the term of the Agreement and any amendments. <br /> 1 <br />
