consistent with the 1975 Livermore Airport Master Plan and Grantee hereby <br /> acknowledges and agrees that no claim of nuisance shall lie based on the foregoing. <br /> Grantee shall not be deprived of any right it might have against any individual or private <br /> operator for negligent or unlawful operation of aircraft. Grantee hereby covenants to <br /> include this same paragraph, in its entirety, in any subsequent deed by Grantee of all or <br /> any portion of the subject property. Grantee further covenants to include this same <br /> paragraph within any lease for all or any portion of the subject property. <br /> 57. In accordance with measure LU-5.2, the applicant shall include deed riders/disclosures <br /> about the Livermore Municipal Airport consistent with Business and Professions Code <br /> Section 11010 and Civil Code Sections 1102.6, 1103.4, and 1353. <br /> 58. In accordance with measure NO-1.1, prior to the City's issuing of building permits for the <br /> project, the project developer shall submit to the City noise analyses prepared by <br /> a qualified acoustical consultant that demonstrate that all structures will meet City <br /> interior noise level standards. Commercial and office uses will need to meet the City <br /> standard of 45 dBA peak hour Leq that would allow the conduct of normal business <br /> activities inside these facilities. Noise reduction features may include, but are not limited <br /> to, building siting, upgraded insulation, sound rated windows and doors, sound rated <br /> exterior wall assemblies, and acoustical caulking. <br /> 59. In accordance with measure NO-3.1, the project developer shall implement construction <br /> best management practices, including the following, to reduce construction noise: <br /> a) Locate stationary construction equipment as far from adjacent occupied buildings <br /> as possible. <br /> b) Select routes for movement of construction related vehicles and equipment so that <br /> noise sensitive areas, including residences, and outdoor recreation areas, are <br /> avoided as much as possible. Include these routes in materials submitted to the <br /> City of Pleasanton for approval prior to the issuance of building permits. <br /> c) All site improvements and construction activities shall be limited to the hours of <br /> 8:00 a.m. to 5:00 p.m., Monday through Saturday. In addition, no construction <br /> shall be allowed on State and Federal holidays and Sundays. If complaints are <br /> received regarding the Saturday construction hours, the Director of Community <br /> Development may modify or revoke the Saturday construction hours. The Director <br /> of Community Development may allow earlier "start times" for specific construction <br /> activities (e.g., concrete foundation/floor pouring), if it can be demonstrated to the <br /> satisfaction of the Director of Community Development that the construction and <br /> construction traffic noise will not affect nearby residents. <br /> d) All construction equipment must meet Department of Motor Vehicle (DMV) noise <br /> standards and shall be equipped with muffling devices. <br /> e) Prior to construction, the applicant shall post on the site the allowable hours of <br /> construction activity. <br /> f) The property owner shall designate a noise disturbance coordinator who will be <br /> responsible for responding to complaints about noise during <br /> construction. The telephone number of the noise disturbance coordinator shall be <br /> conspicuously posted at the construction site and shall be provided to the Director <br /> of Community Development. <br /> g) Additional best management practices may be required by the Building and Safety <br /> Division and/or City Engineer. All additional best management practices shall be <br /> reviewed and approved by the Building and Safety Division and/or City <br /> Engineer, prior to implementation. <br /> 18 <br />
