• <br /> Services that are "not required" shall mean those portions of time that an employee who is a prospective <br /> juror, has not yet been chosen as a juror and has been released for the day but is required to return at a <br /> later date for further consideration as a prospective juror. <br /> "Dismissal" from court is when the judge dismisses the employee as a juror or prospective juror. <br /> 15.4 Leaves Resulting from Subpoena <br /> Leaves of absence with pay shall be granted to a person while going to and from court and answering a <br /> subpoena as a witness on behalf of the Fire Department. If sent off duty, employee will be paid per <br /> Section 7.1 of this M.O.U. <br /> 15.5 Military Leave <br /> Military leave shall be granted in accordance with the provisions of law. All employees entitled to <br /> military leave shall give the Fire Chief an opportunity within the limits of military regulations to <br /> determine when such leave shall be taken. <br /> 15.6 FMLA <br /> The Department will abide by Federal and State Family Leave Acts. <br /> 15.7 Catastrophic Leave <br /> The Department will implement a Catastrophic Leave Policy as outlined in Appendix B. <br /> 15.8 Bereavement Leave <br /> In the event of a death in the immediate family, employees may take paid bereavement leave of up to 48 <br /> hours for fire suppression personnel and 40 hours for 40-hour work week personnel per event. <br /> Employees may utilize other paid leaves (including sick leave) to extend bereavement leave, subject to <br /> approval of the Fire Chief. <br /> In this context only, immediate family shall be defined as: spouse, domestic partner, child, foster child <br /> who resided with the employee at the time of his/her death, stepchild, mother, father, stepmother, <br /> stepfather, mother-in-law, father-in-law, brother, stepbrother, sister, stepsister, brother-in-law, sister-in- <br /> law, grandmother, grandfather, spouse's grandmother, spouse's grandfather, son-in-law, daughter-in-law <br /> or grandchildren. <br /> 15.9 Union Leave Bank <br /> Effective the first full pay period in July of each year, each active bargaining unit employee may <br /> voluntarily elect to contribute to the Union Leave Bank by reducing his/her vacation accrual by four (4) <br /> hours for 56 hour personnel and two (2) hours of vacation accrual or comp time for 40 how personnel. <br /> The contribution will be credited to the Union Leave Bank.
