ORDINANCE NO. 2109 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE APPLICATIONS OF CHICK-FIL-A, INC. FOR PLANNED <br /> UNIT DEVELOPMENT (PUD) ZONING, REZONING, AND PUD <br /> DEVELOPMENT PLAN APPROVAL AS FILED UNDER CASE PUD-100 <br /> WHEREAS, Chick-fil-A, Inc. has applied for Planned Unit Development (PUD) to <br /> rezone a 0.18-acre portion of the existing 1.16-acre site located at 6111 Johnson Court <br /> from the 0 (Office) District to the PUD-I/C-O (Planned Unit Development — <br /> Industrial/Commercial-Office) District, an approximately 0.98-acre portion of an <br /> approximately 1.16-acre site located at 6111 Johnson Court from the 0 District to the <br /> PUD-O District, and establish a zoning designation of the PUD-I/C-O District for the <br /> approximately 0.59-acre vacant parcel (formerly CalTrans surplus parcel) located <br /> adjacent to the 1-580 east bound Hopyard Road off-ramp; and approve a PUD <br /> Development Plan to construct an approximately 5,399 square foot Chick-fil-A <br /> restaurant with two drive-through lanes and related site improvements (the "Project", <br /> also known as PUD-100); and <br /> WHEREAS, at its public hearing on August 22, 2014, the Planning Commission <br /> adopted Resolution No. PC-2014-50 determining that the proposed zoning, rezoning, <br /> and development plan are appropriate for the sites, making findings, and recommending <br /> to the City Council that PUD-100 be approved; and <br /> WHEREAS, on December 2, 2014, the City Council held a duly noticed public <br /> hearing on the application and considered all public testimony, agenda reports, and <br /> related materials, and the recommendations of City staff and the Planning Commission; <br /> and <br /> WHEREAS, based on the Initial Environmental Study, a negative declaration was <br /> adopted by the City Council on December 2, 2014; and <br /> WHEREAS, the City Council finds that the proposed PUD zoning/rezoning, PUD <br /> major modification, and PUD development plan are consistent with the City's General <br /> Plan and purposes of the PUD ordinance. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> Section 1. It approves the rezoning a 0.18-acre portion of the existing 1.16-acre <br /> site located at 6111 Johnson Court from the 0 (Office) District to the PUD-I/C-O <br /> (Planned Unit Development — Industrial/Commercial-Office) District, an approximately <br /> 0.98-acre portion of an approximately 1.16-acre site located at 6111 Johnson Court <br /> from the 0 District to the PUD-O District, and establishing a zoning designation of the <br /> PUD-I/C-O District for the approximately 0.59-acre vacant parcel (formerly CalTrans <br />
