RESOLUTION NO. 14-722 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING A NEGATIVE DECLARATION FOR THE GENERAL PLAN AMENDMENT AND PLANNED UNIT DEVELOPMENT (PUD) ZONING, REZONING AND DEVELOPMENT PLAN FOR CHICK-FIL-A, INC. AS FILED UNDER CASE P13-2533, PUD-100, AND PUD-96-13-02M WHEREAS, at its meeting December 2, 2014, the City Council received a proposed Negative Declaration for the application of Chick-fil-A, Inc. for a General Plan Amendment (P13-2533), zoning/rezoning and Planned Unit Development plan (PUD- 100) for the construction of an approximately 5,399 square foot restaurant with double drive-through lanes, and related site improvements on an approximately 0.84-acre site located south of 1-580 eastbound Hopyard Road off-ramp, east of Hopyard Road, north of 6111 Johnson Court, and west of Pleasanton Square II Shopping Center (5225-6015 Johnson Drive) which requires a PUD Major Modification (PUD-96-13-02M) (collectively the "Project"); and WHEREAS, the Planning Commission at its regular meeting on October 22, 2014, adopted Resolution No. PC-2014-48, determining that the proposed Negative Declaration is appropriate for the Project, making findings, and recommending to the City Council that the proposed Negative Declaration for P13-2533, PUD-100, and PUD- 96-13-02M be approved; and WHEREAS, at its public hearing on December 2, 2014, the City Council received and reviewed the Initial Study, dated October 10, 2014, and received the recommendation of City staff and the Planning Commission; and WHEREAS, at that public hearing, the public was given the opportunity to comment on the environmental impacts of the Project's proposed General Plan Amendment, zoning/rezoning, PUD development plan, and PUD major modification; and WHEREAS, the City Council has reviewed the potential impacts in accordance with the applicable state and local guidelines governing the preparation of Negative Declarations; and WHEREAS, the City Council finds that the Project will have no potential for adverse impacts. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1.
