RESOLUTION NO. 14-722 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING A NEGATIVE DECLARATION FOR THE GENERAL PLAN <br /> AMENDMENT AND PLANNED UNIT DEVELOPMENT (PUD) ZONING, <br /> REZONING AND DEVELOPMENT PLAN FOR CHICK-FIL-A, INC. AS FILED <br /> UNDER CASE P13-2533, PUD-100, AND PUD-96-13-02M <br /> WHEREAS, at its meeting December 2, 2014, the City Council received a <br /> proposed Negative Declaration for the application of Chick-fil-A, Inc. for a General Plan <br /> Amendment (P13-2533), zoning/rezoning and Planned Unit Development plan (PUD- <br /> 100) for the construction of an approximately 5,399 square foot restaurant with double <br /> drive-through lanes, and related site improvements on an approximately 0.84-acre site <br /> located south of 1-580 eastbound Hopyard Road off-ramp, east of Hopyard Road, north <br /> of 6111 Johnson Court, and west of Pleasanton Square II Shopping Center (5225-6015 <br /> Johnson Drive) which requires a PUD Major Modification (PUD-96-13-02M) (collectively <br /> the "Project"); and <br /> WHEREAS, the Planning Commission at its regular meeting on October 22, <br /> 2014, adopted Resolution No. PC-2014-48, determining that the proposed Negative <br /> Declaration is appropriate for the Project, making findings, and recommending to the <br /> City Council that the proposed Negative Declaration for P13-2533, PUD-100, and PUD- <br /> 96-13-02M be approved; and <br /> WHEREAS, at its public hearing on December 2, 2014, the City Council received <br /> and reviewed the Initial Study, dated October 10, 2014, and received the <br /> recommendation of City staff and the Planning Commission; and <br /> WHEREAS, at that public hearing, the public was given the opportunity to <br /> comment on the environmental impacts of the Project's proposed General Plan <br /> Amendment, zoning/rezoning, PUD development plan, and PUD major modification; <br /> and <br /> WHEREAS, the City Council has reviewed the potential impacts in accordance <br /> with the applicable state and local guidelines governing the preparation of Negative <br /> Declarations; and <br /> WHEREAS, the City Council finds that the Project will have no potential for <br /> adverse impacts. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. It approves the Negative Declaration for the application of Chick-fil- <br /> A Inc., for: 1) General Plan Amendments to change the Land Use Designation of an <br /> -' approximately 0.59-acre vacant parcel (formerly CalTrans surplus parcel) located <br />
