RESOLUTION NO. 14- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />ADOPTING AN AMENDMENT TO THE GENERAL PLAN, AS FILED UNDER CASE <br />P13 -2533, REGARDING A CHANGE IN LAND USE DESIGNATION FOR A VACANT <br />PARCEL FROM OPEN SPACE — PUBLIC HEALTH AND SAFETY TO BUSINESS <br />PARK AND AN PORTION OF 6111 JOHNSON COURT FROM <br />RETAIL/HIGHWAY /SERVICE COMMERCIAL, BUSINESS AND PROFESSIONAL <br />OFFICES TO BUSINESS PARK <br />WHEREAS, Chick- fil -A, Inc. has applied for a General Plan Amendment to <br />modify the General Plan Land Use Designation for an approximately 0.59 -acre vacant <br />parcel from Open Space — Public Health and Safety to Business Park, as well as an <br />approximately 0.18 -acre portion of 6111 Johnson Court from Retail /Highway /Service <br />Commercial, Business and Professional Offices to Business Park, to accommodate a <br />new 5,399 square foot restaurant with double drive - through lanes and related site <br />improvements on an approximately 0.84 -acre site located south of 1 -580 eastbound <br />Hopyard Road off -ramp, east of Hopyard Road, north of 6111 Johnson Court, and west <br />of Pleasanton Square 11 Shopping Center (5225 -6015 Johnson Drive) (the "Project "); <br />and <br />WHEREAS, the Planning Commission at its regular meeting on October 22, <br />2014 adopted Resolution PC- 2014 -49, determining that the proposed General Plan <br />Amendment is appropriate for the site location, and recommending to the City Council <br />that P13 -2533 be approved; and <br />WHEREAS, on December 2, 2014, the Pleasanton City Council held a duly <br />noticed public hearing on this application and considered all public testimony, agenda <br />reports, and related materials, and the recommendations of City staff and the Planning <br />Commission; and <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER <br />THE FOLLOWING: <br />SECTION 1. The City Council adopts an amendment to the Land Use Element <br />of the Pleasanton General Plan 2005 -2025, as set forth in Exhibit A, attached hereto <br />and made part of this resolution by reference. <br />SECTION 2. The City Council determines that this is one of the four times in <br />2014 that the Land Use Element of the Pleasanton General Plan 2005 -2025 may be <br />amended as provided in Government Code Section 65358. <br />SECTION 3. The City Council finds that this amendment to the Land Use <br />Element of the Pleasanton General Plan 2005 -2025 is part of the Project for which a <br />Negative Declaration has been adopted. <br />
