5 <br />ORDINANCE NO. 2108 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING THE APPLICATION OF MICHAEL ROESBERY/MD ROESBERY, <br />INC. FOR PLANNED UNIT DEVELOPMENT (PUD) REZONING AND <br />DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE PUD -102 <br />WHEREAS, Michael Roesbery/MD Roesbery, Inc., has applied for Planned Unit <br />Development (PUD) rezoning of an approximately 0.78 -acre site at 3192 Santa Rita <br />Road from Neighborhood Commercial (C -N) District to Planned Unit Development — <br />Commercial (PUD -C) District, and for a PUD development plan (PUD -102) to convert <br />the existing automobile service building to a convenience market and a drive - through <br />carwash facility and to construct an addition to the convenience market, and related site <br />improvements (the Project); and <br />WHEREAS, following a Planning Commission work session for the Project on <br />September 25, 2013, at its subsequent public hearing on August 27, 2014, the Planning <br />Commission adopted Resolution 2014 -42, determining that the proposed rezoning and <br />development plan are appropriate for the site, making findings, and recommending to <br />the City Council that PUD -102 be approved; and <br />WHEREAS, on November 18, 2014, the City Council held a duly noticed public <br />hearing on the application and considered all public testimony, agenda reports, and <br />related materials, and the recommendations of City staff and the Planning Commission; <br />and <br />WHEREAS, based on the Initial Environmental Study, a Negative Declaration <br />was prepared for this Project and was adopted by the City Council at its noticed public <br />hearing on November 18, 2014; and <br />WHEREAS, the City Council finds that the PUD rezoning and development plan <br />are consistent with the General Plan and the purposes of the PUD ordinance based on <br />the findings set forth in the report presented to the City Council on November 18, 2014, <br />and information presented at the public hearing. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />DOES HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. The 0.78 -acre site at 3192 Santa Rita Road is rezoned from the <br />Neighborhood Commercial (C -N) District to the Planning Unit Development — <br />Commercial (PUD -C) District. <br />SECTION 2. The Zoning Map of the City of Pleasanton, dated April 18, 1960, on <br />file with the City Clerk, designating the dividing the City into zoning districts, is hereby <br />
