1. That the development be substantially as shown on the <br /> development plan on file with the Planning Division. <br /> <br />2. That a final landscaping plan showing numbers, sizes <br /> and types of plants be submitted to the Planning Division <br /> for approval prior to issuance of a building permit. <br /> <br />3. That the application as proposed shall be subject to <br /> additional requirements under the City Fire Code. The <br /> applicant is requested to contact the Fire Prevention <br /> Bureau for more detailed information. <br /> <br />4. That prior to filing a final subdivision map on the <br /> subject property, CC&Rs for the development shall be <br /> approved by the City Attorney. These CC&Rs shall provide <br /> for a homeowners association with sufficient power to <br /> manage all commonly owned areas. These CC&Rs shall also <br /> contain a provision requiring gates in all fences to the <br /> rear of the 16 northernmost units and prohibiting the <br /> locking of these gates. The gates are necessary for <br /> proper fire access to the rear of these units. The City <br /> shall be named as beneficiary of the CC&Rs and granted <br /> the power to enforce its provisions if the homeo~ners <br /> association fails to do so. <br /> <br />5. That there shall be a fence completely around the pool <br /> area meeting Pleasanton Ordinance Code requirements. <br /> <br />6. That the minimum setback of patio fences along Black <br /> Avenue shall be 15 feet and that the maximum height of <br /> these fences shall be 5 feet. <br /> <br /> 7. That the developer acknowledges that the City of Pleasanton <br /> does not guarantee the availability of sewer capacity to <br /> serve this development by approval of this project and that <br /> the developer agrees and acknowledges that building permit <br /> approval may be withheld if sewer capacity is found by the <br /> City not to be available. <br /> <br /> 8. That the developer be aware that RAP approval is required <br /> prior to the subdivision of the property or issuance of <br /> building permits. <br /> <br /> 9. That the street number of the buildings be posted so as to <br /> be easily seen from the street at all times, day and night. <br /> <br /> 10. That all ducts, meters, air conditioning equipment, and <br /> any other mechanical equipment, whether on the structure, <br /> on the ground, or elsewhere, be effectively screened from <br /> view with materials architecturally compatible with the <br /> main structure. <br /> <br /> EXHIBIT B <br /> <br /> <br />
