j CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 941 ORDINANCE REZONING 3.2 ACRE SITE OWNED BY JAMES PRICE DEVELOPMENT LOCATED ON THE NORTH SIDE OF BLACK AVENUE BETWEEN HARVEST ROAD AND CRESTLINE ROAD FROM RM-4000 -, (MULT!PLE-RESIDE~IAL) TO PUD (PLANNED UNIT DEVELOPMENT) AND APPROVING THE DEVELOPMENT PLAN FOR A 34-UNIT CONDOMINIUM COMPLEX PUD-80-8 ON THE REZONED SITE WHEREAS, James Price Development applied to the Planning Commission to have a 3.2 acre site located on the north side of Black Avenue between Harvest Road and Crestline Road rezoned; and WHEREAS, based on the Initial Environmental Study and after a public hearing on August 13, 1980, the Planning Commission approved the rezoning of the above-described property; and WHEREAS, James Price Development at the same time applied for approval of a 34-unit condominium complex, PUD-80-8 on the rezoned site; and WHEREAS, after careful consideration, the Planning Commission adopted Resolution No. 1900 approving the development with,,.the ex~eptioDs and conditions indicated therein. THE CITY COUNCIL 0F"T~ CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Approves the rezoning of a 3.2 acre site owned by James Price Development Company located on the north side of Black Avenue between Harvest Road and Crestline Road as shown on the Zoning Unit Map ~211, attached hereto as Exhibit A, from RM-4000 (Multiple-Residential) District to PUD (Planned Unit Development). Section 2: Approves development plan PUD-80-8, which is a 34-unit condominium complex, subject to the conditions enumerated in Exhibit B. Section 3: This ordinance shall be published once within fifteen (15) days after its adoption in "THE TIMES", a newspaper of general circulation published in the City of Pleasanton. Section 4: This ordinance shall be effective thirty (30) days after the date of its final passage and adoption.
