Zoning Unit Map <br /> BACKGROUND <br /> The project site is the existing Valero service station site located in the southeast quadrant of <br /> Santa Rita Road and W. Las Positas Boulevard. The gas station, along with an automobile <br /> service building, was constructed in 1989 for Exxon Mobile. Mr. Michael Roesbery, the <br /> property owner and business operator of the gas station and automobile service business, <br /> wishes to convert the existing automobile service building to a convenience market with a <br /> drive-through carwash facility while retaining the existing gas station operation. The <br /> convenience market would be a 7-Eleven store that would sell alcoholic beverages. <br /> The project site is located in the Neighborhood Commercial (C-N) District. The C-N District <br /> does not allow a gas station with a convenience market or a drive-through car wash. <br /> Furthermore, the non-PUD zoning districts where a gas station with convenience store is <br /> allowed (the Freeway Commercial and Service Commercial Districts) do not allow the sale of <br /> alcoholic beverages. To pursue the proposed uses (convenience market with the sale of <br /> alcoholic beverages and a drive-through carwash), the applicant requests the zoning of the site <br /> be changed from the current C-N District to a Planned Unit Development — Commercial (PUD- <br /> C) District. The proposed PUD-C zoning would require a Conditional Use Permit for the <br /> convenience market with the sale of alcoholic beverages and drive-through carwash. As such, <br /> the applicant also requests the approval of a conditional use permit in order to accommodate <br /> the proposed uses. <br /> September 25, 2013, Planning Commission Work Session <br /> In order to receive early feedback from the Planning Commission and any interested <br /> individuals regarding the proposed project, a Planning Commission work session was held on <br /> September 25, 2013. The Planning Commission provided the following comments on the work <br /> session discussion points (additional comments made by the Commission are in the attached <br /> minutes — Exhibit F): <br /> Discussion Point No. 1: <br /> Would it be appropriate to rezone the site from the current C-N District to a PUD-C <br /> (Planned Unit Development —Commercial) District in order to allow a convenience market <br /> with the sale of alcoholic beverages and a drive-through carwash in conjunction with the <br /> existing gas station? <br /> PUD-102/P14-0014 Planning Commission <br /> Page 2 of 26 <br />
