ATTACHMENT 2 RESOLUTION NO. 14- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING A NEGATIVE DECLARATION FOR THE REQUESTED PLANNED UNIT DEVELOPMENT (PUD) REZONING AND DEVELOPMENT PLAN FROM MICHAEL ROESBERY/MD ROESBERY, INC. AS FILED UNDER CASE PUD-102 WHEREAS, at its meeting November 18, 2014, the City Council received a proposed Negative Declaration for the application of Michael Roesbery/MD Roesbery Inc. for Planned Unit Development (PUD) rezoning of an approximately 0.78-acre site at 3192 Santa Rita Road from the Neighborhood Commercial (C-N) District to the Planned Unit Development — Commercial (PUD-C) District, and for PUD development plan (PUD-102) to convert the existing automobile service building to a convenience market and a drive-through carwash facility and to construct an addition to the convenience market, and related site improvements (the Project); and WHEREAS, the Planning Commission at its regular meeting on August 27, 2014, adopted Resolution PC-2014-41, determining that the proposed Negative Declaration is appropriate for the Project, making findings, and recommending to the City Council that the proposed Negative Declaration for PUD-102 be approved; and WHEREAS, at its public hearing on November 18, 2014, the City Council received and reviewed the Initial Study, dated August 11, 2014, and received the recommendation of City staff and the Planning Commission; and WHEREAS, a duly noticed public hearing was held on November 18, 2014, at which time the public was given the opportunity to comment on the environmental impacts of the Project's proposed rezoning; and WHEREAS, the City Council has reviewed the potential impacts in accordance with the applicable state and local guidelines governing the preparation of Negative Declarations; and WHEREAS, the City Council finds that the Project will have no potential for adverse impacts; NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: Section 1.
