ATTACHMENT 2 <br /> RESOLUTION NO. 14- <br /> RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING A NEGATIVE DECLARATION FOR THE REQUESTED <br /> PLANNED UNIT DEVELOPMENT (PUD) REZONING AND DEVELOPMENT <br /> PLAN FROM MICHAEL ROESBERY/MD ROESBERY, INC. AS FILED UNDER <br /> CASE PUD-102 <br /> WHEREAS, at its meeting November 18, 2014, the City Council received a <br /> proposed Negative Declaration for the application of Michael Roesbery/MD Roesbery <br /> Inc. for Planned Unit Development (PUD) rezoning of an approximately 0.78-acre site at <br /> 3192 Santa Rita Road from the Neighborhood Commercial (C-N) District to the Planned <br /> Unit Development — Commercial (PUD-C) District, and for PUD development plan <br /> (PUD-102) to convert the existing automobile service building to a convenience market <br /> and a drive-through carwash facility and to construct an addition to the convenience <br /> market, and related site improvements (the Project); and <br /> WHEREAS, the Planning Commission at its regular meeting on August 27, 2014, <br /> adopted Resolution PC-2014-41, determining that the proposed Negative Declaration is <br /> appropriate for the Project, making findings, and recommending to the City Council that <br /> the proposed Negative Declaration for PUD-102 be approved; and <br /> WHEREAS, at its public hearing on November 18, 2014, the City Council <br /> received and reviewed the Initial Study, dated August 11, 2014, and received the <br /> recommendation of City staff and the Planning Commission; and <br /> WHEREAS, a duly noticed public hearing was held on November 18, 2014, at <br /> which time the public was given the opportunity to comment on the environmental <br /> impacts of the Project's proposed rezoning; and <br /> WHEREAS, the City Council has reviewed the potential impacts in accordance <br /> with the applicable state and local guidelines governing the preparation of Negative <br /> Declarations; and <br /> WHEREAS, the City Council finds that the Project will have no potential for <br /> adverse impacts; <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br /> THE FOLLOWING: <br /> Section 1.
