CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 939 <br /> <br /> AN ORDINANCE AMENDING CHAPTER 13 (RESIDENTIAL ALLOCATION <br /> PROGRAM) OF CHAPTER 2, TITLE II OF THE ORDINANCE CODE <br /> OF THE CITY OF PLEASANTON <br /> <br />WHEREAS, the RAP provides for lower-income housing through a <br /> special allocation set-aside of units for this purpose, <br /> but restricts use of this allocation to subsidized <br /> projects, and, because of this, to rental projects; and <br /> <br />WHEREAS, potential developers of lower-income housing have <br /> expressed the desire to be able to attempt to provide such <br /> housing without being subsidized and without being <br /> rental housing; and <br /> <br />WHEREAS, City policy is to support and encourage any type of lower- <br /> income housing project, whether subsidized or privately <br /> developed, ownership or rental; and <br /> <br />WHEREAS, the City Council finds that the goal of the provision of <br /> lower-income housing should be encouraged rather than <br /> possibly impeded by the RAP and that the RAP shall <br /> reflect City policy with respect to the type of lower- <br /> income housing acceptable to the City; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br /> Section 1: The following sections shall be amended by deleting <br /> the ~ord "subsidized" in reference to lower-income <br /> housing developments eligible to qualify for the 10% <br /> yearly ~allocation for such housing: Sec. 2-20.05(c), <br /> Sec. 2-20.06 (c), Sec. 2-20.07 (title), Sec. 2-20.07 (b) , <br /> and Sec. 2-20.12. <br /> <br /> Section 2: Section 2-20.06(c) shall be amended in its entirety to read as follows: <br /> <br /> "(c) Allocation for Lower-Income Housing. The City <br /> Council shall establish a special allocation equal to <br /> 10% of the yearly allocation which shall be available <br /> for any lower-income housing development. For the <br /> purpose of this subsection, "lower-income housing <br /> development" shall mean any project (rental or "for <br /> sale") sponsored by any entity (governmental or private), <br /> which would provide housing in all or a portion of its <br /> units to households eligible for federal lower-income <br /> housing assistance programs as defined by the Department <br /> of Housing and Urban Development.
