ORDINANCE NO. 2106 <br /> AN ORDINANCE OF THE CITY OF PLEASANTON APPROVING THE <br /> APPLICATION OF THE CITY OF PLEASANTON FOR PLANNED UNIT <br /> DEVELOPMENT (PUD) REZONING APPROVAL, AS FILED UNDER <br /> CASE P14-0419 <br /> WHEREAS, the City of Pleasanton has applied for PUD Rezoning approval to <br /> modify the zoning on a 0.23-acre site at 4202 Stanley Boulevard from PUD-MDR/OS- <br /> PH&S/WO (Planned Unit Development - Medium Density Residential/Open-Space - <br /> Public Health and Safety/Wildland Overlay) District to PUD-C-O (Planned Unit <br /> Development-Commercial-Office) District to expand the permitted uses of an existing <br /> home from residential only to residential, limited commercial, personal service, and/or <br /> office uses (the "Project"); and <br /> WHEREAS, the Planning Commission at its regular meeting on July 23, 2014 <br /> adopted Resolution PC-2014-34, determining that the proposed rezoning is appropriate <br /> for the site, making findings, and recommending to the Pleasanton City Council that <br /> P14-0419 be approved; and <br /> WHEREAS, on August 19, 2014, the Pleasanton City Council held a duly noticed <br /> public hearing on this application and considered all public testimony, agenda reports, <br /> and related materials, and the recommendations of City staff and the Planning <br /> Commission; and <br /> WHEREAS, the City Council finds that the proposed PUD rezoning is consistent <br /> with the City's General Plan and Downtown Specific Plan, which are simultaneously <br /> being amended in conjunction with the Project, and the purposes of the PUD <br /> Ordinance. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DOES HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The City Council finds that the previously prepared EIR for the <br /> Pleasanton 2005-2025 General Plan which was certified in July 2009 and SEIR, <br /> including the adopted CEQA Findings and Statement of Overriding Considerations, <br /> prepared for the Housing Element Update and Climate Action Plan General Plan <br /> Amendment and Rezonings, are adequate to serve as the environmental <br /> documentation for this Project and satisfy the requirements of CEQA. <br /> SECTION 2. Case P14-0419, the application of the City of Pleasanton to modify <br /> the zoning on a 0.23-acre site at 4202 Stanley Boulevard from PUD-MDR/OS- <br /> PH&S/WO (Planned Unit Development - Medium Density Residential/Open-Space - <br /> Public Health and Safety/Wildland Overlay) District to PUD-C-O (Planned Unit <br /> Development-Commercial-Office) District, a copy of Zoning Unit Map No. 491 is <br />
